Statement of Claim
Claimant says:
"Fraud / A representative from K & C Company knew how much money my daughter had and fraudulently sold my daughter a car at a dealer’s auction for $2800. that was purchased by K & C for only $1000. These people told my daughter that they purchased the car for $2800. and manipulated paper work and charged her an additional $100. for finding her the car. It is my understanding that dealers are not suppose to bring the public to auctions.

  • 08-02-2010 — My daughter asked an employee and Friend of a Friend (Fresh) of K&C to take her to the auction to purchase a car. He asked her how much money she had. She told him that she had $3000. But she didn't want pay out the whole $3000. because that was all the money she had and needed money for tags, tile and inspection etc.. Then they set the date 8/12/10 to go to the auction.
  • 08-07-2010 — My daughter called Mr. Fresh and told him never mind about taking her to the auction, that she had made arrangements with her Uncle to go with him to the auction.
  • 08-10-2010 — My daughter asked an employee of K&C to take her to the Auction to purchase a car. He asked her how much money she had. She told him that she had $3000. Then they set the date 8/12/10 to go to the auction. Mr. Fresh called my daughter from the auction and told her that she brought her a great car for a great price. He told her to come out to the auction to see the car. She met Mr. Fresh at the auction to look at the car. She questioned him about the expense to have general repairs done on the car because of the type of car it was. He told her no and gave her a number to a mechanic that could give her a good deal on repairs if needed. She also noticed that the car sounded very loud and asked about it. Mr. Fresh turned to a guy that was with him and introduced her to the guy as his mechanic. My daughter asked the mechanic about the noise and he told her that it was normal for those types of cars. She then asked how much he paid for the car and he told her $2800.00. She explained that the car was way over her budget but felt bad that he had already purchased the car. He convinced her that she could have gotten a good car for less then $2500. so she had a steal of a deal, when actually he was stealing from her. When she told her Uncle what she brought he intern looked up the selling price of the car on the auction website and found out that the car was sold for only $1000.
  • 08-11-2010 — I (Denise Laws) mother of Dominique Butler called Manheim Baltimore Washington the auction where the car was sold and inquired about the transaction. The receptionist told me that the car was sold for $1000.00 but she could not disclose the fee that they charge the dealers. She also stated to me that the dealer should have not allowed anyone from the public to come to the auction. Then I called K & C purchaser name on the Buyer's Copy of the receipt from the auction and left a message on the business answering machine. A person by the name of Richard returned my call and stated that he was the owner of the company, was not aware of the transaction. He said the he had other representatives at the auction on that day. I explained to him what happened and he said that he would track down the person responsible. We disused what would have been a reasonable price for the car and came to the sum of $1500.00. Mr. Richard said that he would get my daughter's money back or take the car back to the auction. I nor my daughter want to do business with K & C or Mr. Richard again so getting her money back is the best plan.
