If I did not pay my suppliers I would expect to find myself in court. Crazy to end up paying legal fees on top of the invoice. I don't see a response from this company. If owners are having difficulty they should say so and work something out.
In the construction industry, businesses that do not pay suppliers are usually about to go under. Would strongly suggest retaining an attorney sooner rather than later if they do not respond with payment or payment plan.
It is unconscionable not to pay for goods or services received. This appears to be a wholesale contract and JUSTIN & LYNN ACKERLEY- FLORIDA SPECIALTY FRUIT - SENDFLORIDACITRUS.COM presumably sold the fruit to consumers through their company's website and/or store and received payment for that.
I have perhaps old-fashioned values and I consider not paying for something to be theft, whatever the business term for it may be.
As a consumer I routinely choose not to deal with companies that display bad business ethics. By my calculation this invoice was due and payable by the end of February. It's 4.5 months past due.
Has this company given you a reason for not paying or are they simply dodging you? If any portion of the fruit was bad, that should have been reported and negotiated upon delivery- although I've lived in Florida and in my experience, pickers know what they're doing and I can't imagine very much of the harvest being unsaleable.
I cannot suggest any solution or compromise other than that JUSTIN & LYNN ACKERLEY- FLORIDA SPECIALTY FRUIT - SENDFLORIDACITRUS.COM pay their bills and send a handsome apology.
Due to the sum involved, if the company isn't willing to negotiate, you'll unfortunately have to take them to court and ask for costs, which I would guess would be awarded.
Find the solution very fair but will be glad to hear from the other side (If they respond at all ).
