Statement of Claim
Claimant says:
"Yesterday, I went to the JCPenny in Penn Square Mall, Oklahoma City. I needed to use the restroom so I went into the women's restroom. I looked at the toilet seat and did not see anything wrong so I sat to take care of things. I looked down because something did not feel right. I saw that there was a large pile of crap on the floor and unfortunately, my foot was in it. Needless to say, I was and still am freaked out about this fact. I nearly vomitted. I was freaking out and did not know what to do. I had to figure out how to get to the sink and at least wash my hands but I couldn't take my shoes off...the floor was disgusting.
I hobbled my way out into the general public area trying to find someone (Virginia) to help me and to make the least amount of steps to find them with crap on my shoes. I talked to her and she talked about the cleaning staff having left. I said that I really did not care about the staff, I cared about the fact that I had human crap on my shoe and that I was furious about it. She went and got someone and when she (Ivy) came, she really did not offer up much help. She offered me a clearanced pair of flip flops but then left.
Ivy came back with some cleaning stuff and cleaned one of my shoes but not the other but this took forever to have happen. We literally spent about 45 minutes waiting around for things to be done and no one really talking to me and trying to make things better.
After she left and was gone for a while, she came back and asked what could be done to make me happy. I told her I did not really know that I felt like the problem was being treated like it was nothing and that it did not really matter. I had to stand around with people gawking at me and noone really treating the situation like it was a problem to be resolved but a nuisance to their day. I was embarrassed, upset, and nearly in tears. Ivy tried to get the managers to get involved but they did not care that I was suffering in their store but that it was not their problem. When it really was and I was insulted by their lack of concern for my distress brought on by their store.
Eventually, Virginia talked to Ivy and insisted on purchasing me a new pair of shoes so that I could at least get home and so that my whole experience was not a terrible one. I told her that I did not feel that this was her responsibility and that I appreciated it but eventually succumbed because I needed shoes to wear home. I had to take off my shoes and put them in a bag and walk barefooted to the women's shoes which was another embarassment but it is whatever at that point. I was just ready to get home we had been at this for over an hour at this point.
Ivy tried to help but she said that she could only offer what she offered and had no authority to do anything other than what she had done.
In the day of sue happy people, I am happy to say that I am not one of them but this situation truly made me feel that there was a need to make someone pay for not only the crap on my shoe but the fact that it was treated like just a nuisance and so the heck what. I was very upset and freaked out and it did not matter to them. Thus, the reason for the complaint and monetary compensation.
Ivy and Virginia did their best and tried to make things better but their actions were limited and the ones who had the ability to make things better did not care at all. As a matter of fact, they did come out and started causing grief for Virginia who was trying to make things right when she was helping me and taking the stuff to pay for the shoes. They kept nagging her about if she had taken my credit card and she kept trying to explain to them what she was doing. I'm not sure what was said to Ivy but she ran off crying. This was really stellar actions on the part of your upper management.
