Statement of Claim
Claimant says:
"My boyfriend and I both bought used vehicles a few weeks ago and problems started immediately. They safety inspected both vehicles and gave a thirty day warranty. Well engine light was on one vehicle and they said it would be fixed within a few days, the truck's brakes were fading and going down far. they checked it and said were fine. Scott pulled off wheels and brakes pads were gone, and found a lot of other problems in front end and u joints. They traded his truck back and he bought newer truck. My car the escape got fixed and they broke a/c line and tried to charge me 400.00 Scott talked to manager Chris and didn't have to pay but we were told don't bring cars back period they were done with us. now engine light came on they won't even look at it so took it to Mieneke and they said its plugs and struts were gone and leaking oil, sway bar link is worn out and jingling. miller said EGR valve erased code and it came right back on. Scotts new truck was making noises so when he was inspecting it noticed rubbers almost gone on lower control arms and brake rotors had deep chunks missing and pads were horrible also. my escape had no e Brake at all which they did fix. These cars were all safety inspected and were given to us in very dangerous condition. now they refuse to honor any part of our warranty. We have spent almost two thousand dollars out of pocket. Scott's truck still has issues popping up and my vehicle is in shop as I speak and Mieneke is still not 100% yet they got all problems fixed."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Mrs. Voss was provided the opportunity to take the vehicles to a service facility of her choice prior to purchase. She purchased the vehicles with the understanding that they only came with a 30 day 1,000 mile 50%-50% limited warranty that covers the internal parts of the engine, transmission, and differential only. Furthermore Mrs. Voss was offered the opportunity to purchase an extended service plan that would give her more mechanical protection at an additional cost. She opt. to not purchase the protection. After the purchase Mrs. Voss brought both vehicles back with a list of issues that a third party service facility claimed it need to be done on them. All issues got reviewed by management and determined to be maintenance related and not covered under the 30 day 1,000 mile warranty. In keeping with our impeccable customer satisfaction and to ensure customer retention and future referrals we agree to fix a few of the issues on the list provided and agreed to give her a cost quote on the others. The repairs to the vehicles were performed by Jack Miller Auto Plaza (Dealer) as a voluntary, gratuitous, and good will service and not as a result of any express or implied contractual obligation or liability. All express and implied warranties pertaining to the vehicles have been heretofore disclaimed in any manner whatsoever remain unchanged by Dealer's performance of the repairs. Dealer's performance of the repairs did not constitute or should not be deemed to be a course of performance or any waiver of Dealer's disclaimer or any express or implied warranties pertaining to the vehicles. Dealer's performance of the repairs in no way obligates Dealer to perform any subsequent repairs to the vehicles. "
