Statement of Claim
Claimant says:
"I purchased a cd for McAfee internet security 2013 to put onto my computer. I bought it at Radio Shack and installed it on my computer. I simply put cd into cd drive and followed on screen prompts. my computer immediately stopped working and crashed. I asked a friend to look at it and was told the cd itself had a trojan virus on it. I lost 7 months of work that I was writing a book that I wanted to publish. I am out the cost of age cd and cost of having computer looked at and having all programs erased from it. how do you compensate for loss of my work on my book that I was writing ?"

  • I don't think it's very likely that a virus was on a CD, but if it was then an expert should be able to test it. If an independent expert verifies that there is a virus embedded in your cd then you might have a good case with Intel, which owns McAfee.

Also, you should ALWAYS back up your work. Computers crash for lots of reasons, so for your own sake you should back up your work. If no expert can recover your work, how can you prove to Intel that you ever did it? I am not an expert but I would think you would have to prove the extent and value of your work. Lots of people write books that would never earn a dime. If you can show the research or interviews you did then you might have a better case. I would get all that ready in case you need to go to court.

  • McAfee is the manufactured of product. That who I would go to. McAfee has an Executive Escalations Team located on the services and support for Home and Home Office to file a case online. See how they can help. The question How do you compensate for loss of my work on my book that I was writing? Go to payscale.com and find out the pay compensation for writers. Let Executive Escalations Team know your lost wages and see if they can satisfy your claim. I would also consult with a legal aid office to see if you can sue or demand for compensation salary from book or hours invested and lost due to computer crashing from product if in fact true.

  • After researching this issue, I’m under the impression that Trojan viruses install on computers when downloaded, not necessarily from a CD. If the computer had issues due to viruses or some form of malicious program, it may not have been the CD itself. However, if the CD was potentially corrupted in some way, that could have accounted for some of the damage. Have you contacted the customer service line to discuss the issues that occurred with your computer? Because the CD is actually a security software, the technicians may still be able to help reconstruct your computer.
