Statement of Claim
Claimant says:
"I SOLD FURNITURE, AND TV TO SOMEONE WHEN THEY PURCHASED MY HOUSE. THEY AGREED TO PAY 7% INTEREST LIKE THE HOUSE BUT THAT IS NOT IN WITH THE $4000.
HE ALSO OWES ME $5000.00 INTEREST ON THE HOUSE THAT HE PURCHASED

THEY DID NOT PAY ME
THEY OWE ME $9000.00
I HAVE SENT 3 CERTIFIED LETTERS THAT THEY DID NOT ACCEPT AND I HAD A LAWYER SEND A CERTIFIED LETTER THAT THEY DID NOT ACCEPT."

  • I believe in order to create some useful suggestions for this claim, some additional information would be helpful:1) Was there a written, signed, legal contract for the purchase of the house and furniture? 2) Were all terms of the sale written out including purchase price and interest? 3) Was the total amount of the purchase plus interest listed in the contract? 4) Are the new owners currently making payments on the house? 5) Are the payments to you or a mortgage lender? 6) Were the two sales listed separately? 7) Has the respondent paid anything toward the furniture and tv? 8) If you have a lawyer, what has he/she said about the legal remedies? If this person is current on their payments and you are seeking a large sum for interest, it might help to consider letting them make interest payments instead. Perhaps they are in a rough or tight spot financially and are ignoring your letters because they know they are responsible for the money but cannot pay. My best advice is to attempt to work with them as best as you can regarding payments so everyone will benefit: they can make payments and know they are tackling the interest, and you are getting some money toward the total that is owed (which is better than nothing). I might also suggest that in lieu of monetary payment, is there anything else you would accept that might be easier for them? Perhaps giving you back the tv or a piece of furniture that you could sell yourself to recoup some of the money would be an option. Could they provide any type of services to you to work off the money owed? Try to think outside the box for a solution. I truly believe that when people ignore money issues, they are avoiding not because they don't think they owe the money but because they can't figure out how to pay it and it becomes overwhelming for them. Do your best to work out as many scenarios as you can (remember, the law is not the limit) so both you and the respondent will benefit from the solution. Good luck!
