Claimant says:
"Ernie's Body Shop and Wrecker Service ,failed to replace parts paid for by insurance and in the estimate, terrible body work,said front end was fixed new tire not balanced , brakes not fixed ,used same parts that were on truck with damage to them,replaced headlight with one that didn't work, hood and fender crooked,I live in Oklahoma , the wreck was in Arkansas,Hot Springs. They didn't report any of the damage that wasn't on the estimate so it could be repaired. They took almost 5k and didn't offer to make good on the repairs that were done like a shade tree operation. They also damaged the truck when loading it on their truck by dragging it onto a flat bed and refused to report it or fix it. the repairs were authorized one week after the wreck and it took them over a month , while lieing to me about what was taking so long . When I was told to come get the truck I arrived at 8am , they told me they had to adjust the bumper and to come back at noon , it still wasn't ready, they finally called me at 5:30 pm and before I even got to look at the truck they insisted I sign the ins. check. I drove from Oklahoma City and my ride had to be back to go to work the next morning. I was told that they did all the work they were gonna do on the truck and refused to make things right by doing the work or paying someone else to and if I didn't like what was done then I should take it up with my ins. co. I could have done a better job of fixing the truck myself and i'm no body man. I would never give this shop any business again. I feel cheated and lied to, this shop should have to refund the money they took so I can drive a safe truck. I am a disabled Vet and I travel to Hot Springs and Little Rock Arkansas From Oklahoma for treatment for my heart and other Doctors every month. I need my truck fixed correctly by someone with integrity."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "To begin with this customer wanted to write me a hot check, lied to me about having cash (our company does not take out of state checks) for deductibles. Tried to get me to give him money since he went back with the truck, even before leaving tried to get out of paying deductible. I repaired the damages from the actual wreck not previous damage to the standards by law. State Farm paid me to do this job not this customer so he deserves no refund of anything. He has been calling trying to get money since he left. Our company does a good job and guarantees our work as we have told him over and over again just to bring it back and we will correct any of the repairs we were hired to do by State Farm, no previous damages he claims we were suppose to do. When he left everything was done, and the items like a wheel was deducted from his bill and we gave him all the old parts taken off the vehicle except one which is still here. We used all new parts. The tire balance was agreed to by him that would be deducted. This person is the one not telling the truth and just wants something for nothing. We even corrected items that were not on the State Farm Estimate, like checking the rear end and filling it, due to his rear axle seal leaking that was not part of the repair. His girlfriend was very abusive in her language and the way she talked to our representative and said some very ugly things, he did respond in a negative manner but was provoked. The brakes were fine, we did check them. ALL HE HAS TO DO IS BRING IT BACK AND WE WILL MAKE GOOD ON THE REPAIRS WE WERE HIRED TO DO, BUT NOT OLD DAMAGES!!!!! We feel this person is just trying to get something for nothing trying to make a business look bad. His health or status has nothing to do with this claim. Remember we did what we were hired to do and the time it took was due to parts ordering and other items we took care of that we were not paid to do. We feel this is a person that will never be satisfied."
