Statement of Claim
Claimant says:
"I believe I am the victim of a scam or of downright fraud. Let me explain.
In early October, 2015 I ordered what I believed to be a 14 day free trial of Encante eye cream (0.5 oz) and Encante Anti Aging Serum (0.5 oz) from an ad I saw on facebook. It, the ad, led me to believe the only charge would be postage of $4.95. I received the package containing both items a couple weeks later. There was no invoice included in the package nor was there any literature regarding the items sent in the package.
You can imagine my surprise on November 23, 2015 when I received my Visa bill. I had been charged $89.77 for the eye cream and $98.71 for the anti aging serum. I immediately called both numbers shown on the statement I received for an explanation. The first gal I talked to said as I had not responded within 14 days I was charged for the items. At full price??? She also said I was set up for auto ship. I told her I did not want any additional product but she said it had already been sent. I told her I had not received an additional shipment and did not want one. She was very rude to me and when I asked for a supervisor cut me off. I called back and was told I could return the 2nd shipment but would not be given full credit. I was told I would need a RMA# in order to return the items and should call for that when the package was received. I was very upset. I did not see anything on the ad that said I would be charged for anything other then postage nor did it tell me I would be set up on an auto ship.
I told a friend of mine about what was happening and she said "let me call". She talked to a manager by the name of Jay who said he would cancel future orders and that I could return the shipment that had just been shipped but would have to pay a restocking fee of $9.95. I received the second shipment several days later and immediately got the RMA# and sent the package containing both item back to Encante Skin Serum + Eye Cream, PO Box 25380, Santa Ana, CA 92799-5380 .
I just received my November Visa statement which now shows additional charges of $99.01 for the eye cream and $98.71 for the face serum. The only credit on the statement is for the eye cream for $89.06.
Bottom line: I have been charged a total of $386.20 for a 14 day free trial and been given credit for only $89.06. I saw nothing on their ad that said what I would be charged if they did not hear from me within 14 days. I can't help but wonder how many other people have fallen for this. I'm hoping you can help me get the credit I deserve and stop this from happening to anyone else. This "senior citizen" is hoping this letter and/or complaint will do some good.

  • On January 27,2016 my Bankcard sent a letter to me stating they were issuing credits totaling $207.37 to my account. Two for $98.71 and one for $9.95. That letter also said "If the merchant does not agree that you are due credits, your account could be rebilled for the original amount." The credits mentioned are showing on my February statement but until the March statement is received I don't know if I have heard the end of this. The March statement should be received by the 25th of March.

  • Same here. I, however, am pursuing this through not only my AG's office but the home state of this "company". I am with you, I fear for seniors at being taken advantage of by this scam. People with no conscience.
