Statement of Claim
Claimant says:
"Empire Today installed a bath liner in my home. The contractor used gobbs of caulk to secure the liner to the main drain pipe. In time the gobb of caulk has worn loose and water leak has damaged the sub floor, etc. This leak has damaged my foundation, the house has shifted causing the pipes to disconnet from the main drain pipe. Shortly after the installation there was a leak. I called Empire, they sent the contractor back out to assess the leak. he stated the leak did not pertain to his installation. I called a plumber to fix the leak. Now due to the drain pipe issue I have not been able to bathe in my home since May 2012, Empire now refuses to accept the responsibility because I hired a plumber to repair the damage. I could not sit and do nothing if I knew I had a water leak. Empire's insurance company states that I should have filed a claim with the contractor's insurance company.
Why do we let dishonest companies like Empire stay in business? Because they create the mess and then find loop holes to get out of it. They hire unqualified so called contractors that do not take pride in their work.
How can Empire associates sleep at night, knowing that they send these people to work on homes when to them it is just a way to get a paycheck."

  • In August 2012, Ms. Hernandez contacted Empire regarding an installation of a bath liner in October of 2006. Despite that fact that six years had passed between the time of the installation and Ms. Hernandez’s complaint, the matter was referred to the Installer’s insurance company for review. The Installer’s insurance company determined that issues with the foundation of Ms. Hernandez’s home caused damage to plumbing within the home, and that the damage was not the result of the bath liner installation six years earlier. In addition, Ms. Hernandez has had multiple people/contractors perform work in her home in the six years since the installation, including plumbing work.


    We have referred the claim to Empire’s insurance for review. Empire has been in contact with Ms. Hernandez on a regular basis to apprise her of the status of her complaint, most recently on October 10, 2012, and Empire will continue to update Ms. Hernandez.

  • I contacted Empire Today on May 22, 2012 not August, another one of Empire's Today errors.
    The reason I discovered the plumbing issue was because my kitchen sink was stopped up. The plumbers that came to fix it had to replace the kitchen pipes up to the main pipe, due to the pipe being collapsed. In doing so discovered the issue with the plumbng in the bathtub. The plumbers gave me a quote to repair the other damaged pipes then discovered they were not able to do the repairs due to the damaged rotten floor. They then took the gobb of caulk that Empire's contractor used (see attached) to attach the liner to the main pipe.

    I did have a neighbor to replace a toilet in the same bathroom, nothing was wrong with the piping at the time. Empire is now telling me that the damage is due to the plumbing work and the toilet work.

    Empire also stated that the issue was with a worn toilet wax ring. I keep getting different information by different insurance companies and Empire, none of which want to accept the responsibility.

    I was told by Empire on October 10. 2012, if I were to sue I would have to sue the plumbers and the gentleman that installed the toilet. I called Empire's insurance company and notified them that I did not have the heart to bring the gentleman into the lawsuit, I could not sleep at night knowing that I had financial gain and hurt them in the process.

    I have attached a picture of Empire's work, you tell me if Empire is not liable for half of the damage. Is this the correct amount of caulk used to secure a bath liner? According to the contractor's insurance company he admitted to using the caulk. I have talked to my neighbors regarding Empire and looking at the internet Empire needs to hire knowledgeable contractor's. This contractor is not even a licensed plumber.

  • I received a letter from the Office of the Attorney General of Illinois (Lisa Madigan) stating that I would receive a letter regarding a possible settlement. I have not received such letter nor have I received a letter regarding the result of the engineer sent to my home by Rimkis.
    Empire, I am still waiting.
    I plan to file a complaint with the state board of plumbers due to the fact that Mr. Granger the contractor you hired was not a licensed plumber.

  • Empire Today, LLC (“Empire”) has referred the claim to Empire’s insurance company. The insurance company has been reviewing the damage claim that Ms. Hernandez states was the result of the installation 6 years ago. Due to the length of time that has lapsed, the investigation does require a full investigation.

    We continue to keep Ms. Hernandez apprised as updated information is available, or she can contact the insurance company directly.

  • While Empire is looking into the issue on their end, perhaps having your home inspected by an independent third party can help make some sense of the damage you seem to have suffered. After that, talking to a legal professional about the issues involved may be beneficial. A legal professional would be able to tell you who would need to be involved in a legal dispute if you selected to go that route for resolution. Here, however, I think having an independent inspection will help towards figuring out if the damage was caused by faulty installation.
