Statement of Claim
Claimant says:
"Wife lost the steering in her SUV. Took it to Ed's on 8/7/12, because it was just down the street from the wife's place of employment. Told it needed a steering hose at a cost of $74.78. When we picked up her SUV on 8/8/12, we had my van towed to Ed's, which needed some work. Upon returning home with the SUV, we noticed the power steering fluid leaking all over the drive. Had it towed back to Ed's. Told it needed a rack and pinion unit at a cost of $501.04. Authorized the repair and upon taking possession of the SUV on 8/9/12, found it pulled to the left and made a funny sound when turning. Was told by one of their mechanics that there was nothing that could be done to alleviate the noise or the way it pulls to the left. We decided to wait until we got the van back to address that issue again as we had no other means of transportation, due to the fact that we live out in the country.

On 8/11/12, we received an estimate of $1,541.19 to replace the engine which we were told was no good , even though it was taken in because of a knock in the engine. I'm not a mechanic so I don't know about such things, but was told it could no longer be driven safely, so we authorized the repair. While the shop was waiting on delivery of a rebuilt engine, I received a phone call from Ed who said we needed a complete brake job, at a cost of $750.57. Said it needed wheel cylinders, rotors, pads, and brake lines, pretty much the whole system. Once again, because we needed the vehicle, we authorized the repair. Total estimate of repairs, $2,291.66, actual cost, $2,646.84, with a difference of $355.18.

Picked up the van from the shop on 8/23/12, barely made it the 8 miles home, it wouldn't shift into high gear. There was nothing wrong with the transmission prior to taking it to Ed's. Had it towed back to the shop the same day. Received a phone call from Ed on 8/25/12 who said the van was ready. Ed handed me a bill for $121.28, which I refused to pay, decided to pay half as I believe it was their mistake when attaching the engine and the transmission. Made it half way home and turned around and returned the van as it still would not shift, was told it needed adjusted. Picked the van up on 8/27/12, was told it was fixed. Once again had to return it the same day, due to the transmission not shifting.

On 8/28/12, as I was going to pick up my wife from work, I passed by Ed's service center and observed my van up on his rack. Upon returning home I received a voice-mail from one of Ed's mechanics who told me I needed a new transmission. 5 minutes later I called Ed and told him not to take any further action concerning the van, and that I would be coming to pick it up and take it elsewhere, to which he replied it's not here. Ed told me it was at a transmission shop and they were closed so I would have to wait another day. A few minutes later I received another voice-mail telling me the van was out in front of Ed's service center and the key was in the center console. I picked up my van and carefully drove home very slowly.

At no time were any of the used parts offered for my inspection."

  • This in response to the complaint lodged by Mark Hafner On Tuesday Aug. 7 2012 Mr. Hafner’s wife left a 1997 Ford Explorer at our shop for a power steering leak. The mechanic on inspecting the system found the high side power steering hose leaking. Mr. Hafner was called with an estimate of $74.78 at the same time he approved that repair he also approved putting on four used tires. There were other things brought to his attention: front wheel bearings were lose, the axle seal is leaking and the rear shekels are broken. Mr. Hafner declined having those things repaired and it was noted on his work order. On Aug, 20, 2012 Mr. Hafner called and said there was a power steering fluid leaking from his Explorer. A tow truck was dispatched to bring his explorer back to our shop. This time the mechanic found the rack and pinion leaking. He was given an estimate of $474.42 plus towing and tax. ( He was also given a $20 discount on towing and a AAA discount of 5% on parts and labor,) He came back in shortly after picking the vehicle up and talked about a growling noise. The mechanic told him that the power steering pump had run low on fluid too often that it had left some residual effects (growling noise) but he never mentioned it pulling in any direction, if that was the case the alignment would have been redone.
On Aug. 16,2012 Mark Hafner’s 1997 Plymouth Voyager was towed to our shop with a knock in the engine. Mr. Hafner reported that he had put oil in the van but that the engine was knocking as he drove it. Upon inspection by the mechanic it was noticed that the oil was too dirty to properly lubricate the engine. The oil was changed and the van was idled till it reached operating temperature. The rod noise still persisted and it was determined that the engine had run too low on oil for too long. Mr. Hafner was called and given an estimate for replacing the engine of $1797.51. The estimate for all four brakes was $935.44 ( I was able to find parts from an alternative supplier and lowered the brake estimate by $224.00) Mr. Hafner also told us that the van had been sitting for 1-2 years. When Mr. Hafner brought the van back because of a shifting problem the mechanic found that the transmission fluid was very dirty. The transmission fluid was changed and the van was test driven to operating temperature. At that time the mechanic noted that the van shifted fine and the engine ran smoothly. Mr. Hafner picked up the van and again called back that he was having trouble with the shifting. While that is not what was repaired I agreed to look at it again. We tried adjusting the throttle cable and even took it to a transmission shop for a second opinion. The transmission shop thought the front pump might be going bad. They said if it had been sitting awhile the seals might have started to dry out, causing the pump to start going out. I really feel that we have tried to address all of Mr. Hafner’s concerns. When we received the van we were not able to drive it because of the brakes and the condition of the engine. I did not work on the transmission and I am unwilling to take responsibility for any thing that might be happening with that.

  • After reading the response from Ed's service center, let me respond in kind, as for the Ford Explorer, Ed claims that I received a $20 discount on the towing. I am covered by AAA so there should not have been a towing charge to begin with. As for the 5% AAA discount on parts and labor, I see nothing on any of the five bills from Ed's service center that would indicate a discount of any type. As of this writing, the Ford Explorer is no longer running, seems Ed's service center elected to splice the steering hose as opposed to replacing it. This was found by an independent mechanic, (can't wait till he looks at the repairs on the Plymouth Voyager).
As for the Plymouth Voyager, I never said it sat for 1-2 years. It did sit for 5 months but was moved every week to make sure nothing froze up. It took 3 days for Ed's to remove the original engine and when I call to find out the progress of the van was told they were having trouble removing the engine, I believe this is when the transmission was damaged or otherwise made inoperable. Ed says they never worked on the transmission up to this point by seems to me you wouldn't have a choice since the engine and transmission are in fact attached. After returning the Plymouth Voyager a second time, I was contacted by telephone and told by Ed that the transmission shop was explaining over the phone how to repair the transmission. Ed said they adjusted some belts and the governor. Here's my question, why would anyone attempt to work on something their not qualified to repair?
