Claimant says:
"I am a resident of the Palmer Oaks Development in Sarasota, FL where D R Horton Builders is building additional condominium units. I need to drive by their construction site in order to reach my home and two weeks ago my car tire was punctured by two roofing nails from near the new construction. The car and tire in question were new, 483 miles on the tread, and because of the nails being so close to the sidewall, the tire was not repairable, per the dealership where I purchased the car. I paid $306.84 for a replacement tire and contacted the D R Horton superintend, who was in charge of the construction sites and asked for reimbursement. I was told that it was D R Horton's company policy not to reimburse for tire damage. I then emailed the D R Horton headquarters asking for someone to contact me regarding my request for reimbursement. I have received no contact. (Attached are photo's of the construction sites with nails on the ground along with a photo of the nails removed from the tire and the invoice for the new tire.)"

The claimant's settlement terms were rejected with the following explanation:

  • "Hello Stephen,

    I spoke with our Vice President of Construction who said he has reached out to you in the past about this issue and explained why we will not be paying for your tire. As there can be many places on the road where nails are present, there are multiple ways to exit the community without driving past our construction site, and we cannot determine if the nail came from our construction site, we will not pay for the tire replacement. "
