  • The incident occurred when my wife, who dispenses all of my medications, had the opened bottle of my methadone prescription next to the bathroom sink. Our god damn cat jumped on the bathroom sink top and knocked the opened bottle of methadone into the bathroom sink, which had a small amount of water in it.  A majority of the pills landed in the water and immediately started to dissolve. It was suspected at least 25 to 30 tablets were unrecoverable. This was a mere accident and no way to insinuate there was any type of malice or abuse by not following the prescribed instructions.  This incident was brought to my primary care physician and my wife spoke with my pcp to verify the validity of this mishap.  I have been on methadone for over 5 years and not once have I ever came up short on this medication.  My PCP believed this was an accident, that could have been avoided, but otherwise acknowledged the incident.  My PCP wrote a prescription for the approximate amount of missing 10 mg methadone tablets.  When this prescription was produced to my pharmacist, I was later told by the pharmacist that if I have that prescription filled, my pain management doctor would no longer see me as his patient.  I immediately called the pain management doctor, Dr. Magimbi and I spoke with his receptionist Theresa. After explaining all the circumstances to her, she told me Dr. Magambi thought I was lying and she would not let me speak to the doctor period.  When I stated I was going to drive to his office to explain the true circumstances, she threatened to call the Tracy Police on me and said I would be arrested onsite if I were to show up there.  At this point, I was utterly shocked she threatened to have me arrested if I came to my doctor's office. Never in my life have I ever been threatened to have the police called on me for any reason what so ever. During the conversation with the receptionist, I never raised my voice or spoke to her in a threatening manner and to de escalate the situation I calmly asked for my appt date and time for my visit with the doctor, which was set for March 21st @1245. I showed up on that date and time and the receptionist acted like she did not know me, even after speaking with her face to face every month for a year.  When I told her my name she said I had canceled my appointment. She proceeded to pick up the daily schedule from the front counter and I could clearly see my first and last name in the time slot I was scheduled. She quickly turned the paper over and stated I was not on the schedule and said I cancelled the appt and re-scheduled it for the 28th.  She also said that I threatened to call the police to make a report, but she could not say why I would have called the police. Anyway, the receptionist lied to my face, saying the doctor was not in the office, when I could clearly hear him talking in one of the examination rooms or back office.

    I feel Dr Magimbi had fallen below the standard of care for allowing me to go through opioid withdrawal for 4 days by going off of what his receptionist told him and failing to take my call, even after it was explained to him I would be in opioid withdrawal for several days.  Dr. Magimbi should have had the decency to talk to me or my wife directly to explain what had originally occurred and this whole incident could have been avoided.

    I have never had any prior issues with Dr. Magimbi and I was very satisfied with our doctor patient relationship. I am very disappointed in his lack of judgement to speak with either myself or my wife when I requested him to do so.
