Statement of Claim
Claimant says:
"I lived in a rental home in Madison, MS for the past three years. The landlord was David Ingram. I always paid him the whole year rent at the beginning of my new leasing year and never brought him any trouble. In early April I notified him I was going to move out before my third year lease run out in May 31. I gave him two month notice and I thought that was plenty. He told me I need to clean the house, cut the grass and return the keys when the time came, and he would refund my $1200 security deposit if I meet all above three requirements.

I did everything he asked. But almost one month passed, I still didn't see any refund from him. I called to ask why he didn't give me the deposit back since I didn't do any damage to the house. He told me he decided to forfeit my security deposit because I did not let him bring the potential renters to my house everyday in the last two months when I still lived there. I said I did let you bring strangers to my home and always cleaned the house before you came. I just couldn't let you do it everyday because the timing had to be convenient for me as well. But he still forfeit my $1200 security deposit because this."

  • Per Mississippi law, the landlord may claim only the parts of the security deposit which are necessary to remedy defaults in payment, to repair damage, normal wear and tear, and cleaning of the property. The landlord must present an itemized list as to why portions of the security deposit are not being refunded. The reason sited above does not fall under the exceptions allowable under the law, and the retention of security deposit in violation of this and lacking good faith, the landlord can be subject to damages not to exceed $200 (Mississippi Code of 1972, 89-8-21).
