Statement of Claim
Claimant says:

To Whom it May Concern:

We purchased this F350 Truck from you on August 17, 2012, driving up from Georgia to pick it up, based on your listing on Ebay. We paid the total listing price of $9950. We paid $500 deposit by credit card and $9450 in cash.

This listing was advertised as running well, all power windows working, good air conditioner etc etc.

We have sense paid $5217,77 in less than a month, just to be able to drive it.
We had trouble getting it back home to Georgia.
We have made 11 one way trips to take it back and forth to mechanics and parts stores to get it to run.
We have travelled 480 miles at $4/gallon for two vehicles (so someone can bring us home) to get the truck fixed.
We have taken four hours of time off work to deal with this during business hours, with the mechanics.
We have paid $40 in labor to the guys in our business, to run us back and forth to the mechanic.

And it STILL is not running right. We still need to pay another $400 labor to take the motor back apart, and replace some other injectors. Plus the mileage, plus the labor for someone to bring us back- AGAIN.

$40 Labor to Machine Shop Employees for providing transportation back form mechanic
$160 Lost time from work for running back and forth to the mechanic during business hours.

$5217.77 For the GRAND TOTAL spent within one month to get this truck running



Plus the back windows still do not roll up and down as advertised on the ebay video, the air conditioner only blows cold for a few minutes, then freezes up and blows only hot. There is a popping underneath which still is not figured out.

Other things which were not completely legitimate: The truck was taken off ebay “to avoid fees” We believe this had more to do with avoiding any recourse Ebay offers.

Also, the main problem the truck has, is starting first thing in the morning. We indicated, that we would like to arrive first thing in the morning. The main reason for this is to do the first cranking of the day for the vehicle. But before we arrived, this truck was cranked and warmed up.

We were told not to arrive at your normal opening time, because you and your partner needed to do some errands and would not be opening until 9am instead of 8am this day. When we arrived, a few minutes before 9am, the shop was in full swing, there were several workers with all of their tools out, in the middle of projects and it sure did not look like they had just gotten there and the shop had just opened. It looks like to us, that you guys knew the truck would not crank easily first thing in the morning, and wanted to make sure we did not realize it. This is dishonest and unfair.

So we are requesting for you to please, at least, credit our discover card for the $500 deposit, as we do not believe this truck was “ as advertised.”

We do not plan to pursue any recourse for the $9450 at this time, but would just appreciate a credit of the $500 on the credit card, to help pay for some of these repairs.

  • We are trying to respond to a claim filed againist us. when click respond and enter the claim number it then asks our name in which we type in and it says invalid info????

    We are rejecting this claim.
    Mr. Saylors purchased a 2002 F350 with over 250,000 miles from Custom Wheels, Inc. They flew into Florida and inspected the vehicle in person before making final payment. This vehicle was sold as is with no warranty. Mr. Saylors signed approximately 4 times that this vehicle was sold as is. Also stated in all of our online adds the vehicles are sold as is. Approximately 2 weeks after he took possession of the vehicle they sent me a letter and repair bills requesting I credit his credit card back $500.00. Before I even had a chance to respond he disputed the deposit charged on his credit card. My credit card company put the $500.00 on hold during this dispute process. So I did not have those funds. After numerous attempts of trying to contact Mr. Saylors we spoke on the phone. He explained to me his concerns with the vehicle. I then told Mr. Saylors that I had to respond to my credit card company in regards to the dispute. They were requesting a signed terminal receipt and a bill of sale.I sent them the information they requested. I told him that I did not have the funds but after the credit card company released the funds I would give him the deposit back if the credit card company gave me the money. I still have not recieved any information or the funds from the credit card company. Instead Mr. Saylors decided to make public claims aganist my company in which has been in business for 18 years. Because of the fact that he is publicily discrediting my company I refuse to give any kind of credit. As stated above the vehicle is sold as is and I have no obligation to give any funds back.

  • I see the respondent responded with information that influences the suggestions I would make. The used car was purchased in an “as is” condition, which means inspecting the car by an independent third party was up to you as the buyer. In Florida, there is no used car lemon laws, and the attorney general’s website specifically states that cars sold as is, with no warranties, the car should be inspected so you, as the buyer, can know what potential repairs would be needed if the car is purchased.
