Statement of Claim
Claimant says:
"Account # 102534903 - Paul Atkinson, 167 Browntown Rd., Prospect, VA 23960
On Jan. 4, 2016, my wife and I opened a Consumer Cellular account and purchased a phone for $84.76. On Jan. 13, 2016, we decided to stay with Verizon. We called and cancelled our account on Jan. 13th and returned the phone and all merchandise we received on Jan. 14, 2016. We received a refund for $84.76 on Jan. 21, 2016. On Feb. 8, our bank account was charged $175.16 for usage charges. When we talked to a representative on Jan. 13th, he informed us that we were within the trial period of 45 days or 450 minutes or 450 text & web data. When the charge of $175.16 was taken from our checking account, I called Consumer Cellular to find out what the charges were for. I was informed that we had talked for 511 minutes and used 1130 text & web data. We had not received any written bill from your company. My husband and I disputed the charges and the bank has since refunded the $175.16 to our account until they could resolve the issue. Now on Feb. 17, I received a letter from your company telling us we owe $200.16, the original amount due plus a $25 late charge. We feel we don't owe your company any money due to the fact we were told we were within our trial period usage, and even if we did go over, we certainly didn't go over our monthly usage of 3500 minutes and 1.5GB of unlimited texts and web data. If we should be charged anything, it should only be charges for one month, $38 for 3500 minutes and $19 for 1.5GB of web data. While talking to one of your representatives, we were told of automatic updates on the phone which would have caused more usages of data, but no way could we have used $175.16 worth. We feel your company, or some one of your representatives is overcharging your customers for data not used. Also, after cancelling our account with your company, our automatic payment should have been cancelled as well. That first charge of $175.16 should have been sent by a paper bill and not withdrawn from our account. Please reply to this complaint. We are on a very fixed income and cannot and are not prepared to pay those outstanding charges of $200.16."

"They did a similar thing to my daughter under my account number but I'm the one not able to use their services. nor are they going to unlock the phone I purchased in full from them."
