Statement of Claim
Claimant says:
"We went to the AT&T store,which turned out to be a rep store, to see about a replacement phone for my wife. The salesman, Don Smith, told her "because of our being with AT&T for over 9years, she could get any phone without cost, only pay the taxes. So she picked out a phone and it was set up for her. 2 weeks later we get a bill for almost $700.00 for the phone and I returned to the store and told him he had lied to us about the cost and we were returning the phone. He told us it was to late to return the phone and we would have to pay for it anyway. I told him we would not pay that kind of money for any type of phone and that he had lied to us about the cost. I reminded him he even told me our monthly bill would would be reduced by about $20.00 and that was also a lie. I told him they could keep the phone and we left. I contacted AT&T and explained what happened and their customer care claimed to have contacted Cellular World and were told they never got the phone back. I told the service rep from AT&T that was another lie and I had 3 people with me when I gave the phone back to Don Smith. He had refused to give us a receipt and kept saying " we won't take this back" . We have continued to pay our regular bill minus the additional charges for the phone we returned. I spoke with a manager at AT&T and they claim the company is still claiming they don't have the returned phone.

Update May 23 2016

Through some miraculous means Cellular World found the phone they claimed we never returned and AT&T has acknowledged the receipt of the phone but they are still charging me for the phone service I quit and they had disconnected service. After they claimed to have located the missing phone they returned service to one of the phones we had had and refused to relinquish the phone number to the new company, We have had to receive a new number for the new phone and the old phone is still active."
