Statement of Claim
Claimant says:
"I recently applied for a job at the store located on Cemetery Rd. in Hilliard Oh and was refused a job because of tattoos on my hands. I was told it was unsanitary. I have had my tattoos for 3 or more years so they are not new. I feel that it is discrimination and I want it solved. My tattoos are not derogitory in any way and I even offered to purchase my own gloves that would cover up my tattoos and was told it was still more unsanitary than if I didn't and that was the reason I was not hired. I had thought I was going to get the job so I went to the interview and missed another one with another company so now I have to seek employment once again and my bills are now late. If this is not resolved I am going to look into pursuing charges for discrimination."

  • Unfortunately, discriminating against someone who has tattoos isn't illegal. It is the employer's right to not hire someone because they have tattoos, pink hair, how they dress, etc... Title VII of the Civil Rights Act of 1964 only prohibits employment discrimination based on race, color, religion, sex, or national origin. If you have your tattoos for religious reasons, you may have a case but you may find it difficult to find an attorney to take this on. What is it that you are truly seeking? Would an apology suffice? My suggestion is to write them a certified letter letting them know why you would have been a perfect fit for the job and why you are unhappy with their decision. If it is monetary damages you seek, you are unlikely to receive anything but it never hurts to ask. I hope, in the meantime, that you have found suitable employment. Good luck in resolving this.
