Statement of Claim
Complaint Involved (1) - View
Claimant says:
"I had car problem while driving home thru West Virginia. My car over heated so I had c.j. Auto tolled my car to there shop. He asks me to have a seat while he looked at my van. He left and come back ten minute later quoting me a starting price of seventeen hundred I never seen the the hole he say I had so I asked him can I pay him to hold my van for a few days because I was from out of town. Two days later I made arrangement to have my van pick up through new way moving service. I contact c.j. And explain to him someone was suppose to pick my van up within a week. He went on to be very rude asking for money which I did send him the money to hold my van for that full week. After having troll moving my van I contact c.j. And explained the problem and that I would send more money however after getting the run around I just told him I would leave the van and send him the title if he send my plate and the things that in my van he agree to do it however three weeks passed I never received my plates or the items that's in my car. I called mr. C.j. Asking for my paltes he stated he mailed them and he don't know why I haven't received them he stated he would go to the post offices and give me a call back I never heard anything from him"

  • As of 1-24-2014 Mrs Hardmon owes 2400.00 for storage she has until friday 1-24-2014 close of bus. day to pay and pick up the car and pay the storage bill, or car will be sent to the crusher for disposal.

  • If this case is not resolved here I will go into a small claims court now he can crush my car if he want. He keep saying he sent the plates to my car which is a flat out lie. From my understanding the car was supposed have been crushed. Now he has saying I owe him 2400.00 if I don't receive my plate I will have to go beyond this like I've stated I have each recorded ca even from when he first tried to state he didn't receive my first stogage fee I have tried to work hard with c.j. But keep getting the run around the last time I spoke with him explaining I never received my plates he stated he was going to go to the post offices and see why I never received my platewhich he never called back. Would like to know what wa the address the plate were mailed to and the copy of the conformation number he claim he have. This is something I will not allow to happen he is a scam

  • Also of note is the fact that samantha hardmon is not the vehicle owner of the car in question.So why has the vehicle owner never contacted us?Maybe he has the plate as they were mailed to him!

  • Ok so if I understand correctly this is all about a couple of license plates? No care about abandoning the car in another state? No care about abandoning the car on private property?No care about how someone whom does not own it is going to dispose of it? You are just worried and pissed off about a couple of licenses plates.

    What is this really about? Humm

    Heck cj's would be willing to buy a couple of new license plates if in fact they did get lost.

    Did you ever think to ask the people at cj's if they knew of anyone that could transport the car?They are in the auto business.

    Did you ever check with the vehicle owner to see if he has the plates? They were mailed to him not you.

    Why is he not the one complaning on this forum? Why have we not heard from him?

    Did you rent a car to get back to chicago? You could have rented a truck or van with a tow dolly and taken the car with you.Uhaul and enterprize have good rates on rentals not much more than a car rate.

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "While it is true that Samantha Hardmon did break down in west Virginia and CJ'S Automotive did tow and did diagnosis the car,that is the only part of her statement that is true. We checked out the overheating car and informed her of what had happened. We also gave her a price to preform the repair,and informed her that it was not worth repairing.She asked if we could give her and her friend a ride to the hotel and would call the next day to arrange for the car to be removed. At that point she did pay for the tow and the work performed thus far.We did inform her that it is our policy to charge storage on vehicles left here ;it is clearly posted on our service counter.We gave her a ride to the hotel FREE of charge.
    About a week later she called and stated that a transport company would be picking up the car and she asked what she owes us for storage. She said that she would send a money order which she did do. However no one came for the car.
    Two weeks later she called and stated that she was have problems finding someone to transport the car; apparently no one would do the job.I told her it cannot just sit here she said that she would get back to us. About two weeks later she called again and stated that it was not worth anymore of her time or money and if we could scrap the car.I replied that it was possible but we would need the title as all the local scrap yards must have a title in order to scrap/crush a car. She said if she send the title would we send her the plates on the car, we replied yes.

    Three weeks went by before the title came in the mail, the next day I put both plates and everything that was in the glove box into a large envelope and mailed it to her.My local post office told me that she did in fact recieve it as they have a delivery conformation.
    As of current date Samantha Hardmon ows CJ'S Automnotive 2100.00 for storage.If she want the vehicle she can come and reterive it.

    And to be clear CJ'S Automotive did not cause the breakdown nor did CJ'S Automotive decide to leave the car in West Virginia and return to Chicago without taking the car."
