Statement of Claim
Claimant says:
"We have attempted to find a way to cancel and obtain a refund for a contract with Bluegreen Corporation due to misrepresentation of their company's benefits and breach of the good faith law for the last 6 years. We have personally contacted Bluegreen several times on this matter and been directed to Pinnacle timeshare resale (which was a dead end) or been told we could let it go to foreclosure and ruin our credit. We have also tried to sell it on Sell My Timeshare Now to find out it was worthless and we couldn't even give it away. We have tried enlisting the help of other Bluegreen owners that have filed complaints and in turn also filed a complaint with the Better Business Bureau. Bluegreen has been unwilling to negotiate an agreement with us after offering a refund of $1500 even though we have paid over $22,000.
We were unable to use the timeshare for a few years due to pregnancies. We personally attempted to make use of the timeshare at other times being we had paid for it. We were only able to use the timeshare 3 times in the last 6 years and were left with giving away the use to family because otherwise we were literally paying for nothing since we have points that expire annually. There are several restrictions with using their resorts and we have been severely limited in our options and have been left to pick mini vacations around several restrictions or face literally paying for nothing. With these limitations we have still been forced to pay annual maintenance fees that continue to rise which are now around $800.00 yearly with no added benefits.
When we bought 7 years ago we were promised ease of vacationing around the world which would save us money. We were told that owning with their company would increase in value and could easily be sold for a profit. We were told maintenance fees wouldn't really increase much from around $250.00. Everything was completely untrue. We have asked to be released from this contract as it is not following suit with what we were assured when buying. We have asked for a refund for the fair amount we have paid after deducting use for the 6 times we used points with their company. Bluegreen has refused to negotiate this after only offering to refund 2 years worth of maintenance fees ($1500) and now states we are not entitled to a cancellation of our contract."
