Statement of Claim
Claimant says:
"I bought a car in 2006 from big valley ford. I had it until august 2013. When I traded it in the car dealership I traded it into called me 3 weeks later. They told me that this car was a salviged car from back in 2004. Now they can't do anything with the car. I was shocked Big Valley Ford never informed me of this problem at all. I wouldn't of bought this car if I had known this. I tried calling Big Valley Ford and talked with the General Mgr and he hung up on me and just laughed in my ear. Then the General Manager from the car co that I traded the car into also tried calling and he spoke with the general manager also at Big Valley Ford and he also hung up on him too. I am now looking into sueing Big Valley along with the Car Co I traded the car into with. I want my money back for the car I bought from Big Valley Ford and the car I traded in for the car I bought at Big Valley Ford. I plan on going onto the news to let all consumers know what happened to me.Thank You Laura Kniffen."

Additional Communication Between Claimant and Big Valley Ford Hide
  • Jan 03, 2014, Big Valley Ford (responding party) added:
  • We are uncertain where anyone is getting information that the vehicle in question is a salvage unit. There was no record when we sold this vehicle that it had a salvage title nor does California Motor Vehicle indicate today that this vehicle is or ever was a salvage unit. We believe Ms. Kniffen has been given incorrect information regarding the vehicle status. I would recommend that she visit her local DMV office and get a print out of the title and discuss with a DMV representative. Had this been a salvage unit we would not have been able to finance the sale of the vehicle and she would have had dificulty obtaining insurance for the vehicle. We have all of our records and stand by our representation of the vehicle we sold her in February of 2006.

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

"This vehicle was sold to Mr. & Mrs. Kniffen 2/19/06 with a clean title and as of today the Department of Motor Vehicles indicates this vehicle still has a clean title. I would recommend the Ms. Kniffen contact the DMV and review with them. We would not have been able to finance this vehicle with a salvage title and Ms. Kniffen would have found it difficult to insure the vehicle also. We have all documents necessary for proof in our possession."
