Statement of Claim
Claimant says:
"My older dog went in for grooming. The owner was told of her breathing problems and we wanted her done by noon. She was dropped off at 8 Am. At noon I was told to come back at 2PM. I should have checked on her, but trusted them. When I picked her up they said "your dog gave us a scare, she was biting at the fence. The arrogant owner said, "we thought she was having a heart attack!" Did I ever get a phone call.....NO !

My dog proceedd to bleed internal (severe heatstroke) her protein was breaking down and she could not stand. He said ". Take her home it's anxiety there is nothing a vet can do"! We got her to to the closest vet and her temperature was 108. Lund Animal Hospital got her stabilized and she was transferred to West Palm Beach in ICU for 3 days. We had many ups and downs and on Day 4 she died. When I went to tell the owner I got no sympathy, and it was not his fault. He could tell my dog was in distress and never called or stopped treatment. I am mad and never want this to happen to another dog again. Help!"

  • My name is Daniel Rose, Esq. I represent Barkingham Palace and have for over 8 years here in Delray Beach. My clients have groomed over 200,000 dogs in their 40 year career and have never had a dog die on them and had never had a complaint against them with any agency and has never been a Defendant in a lawsuit.

    I spoke to my client and they informed me that the dog was groomed and there were no issues during the grooming except for the fact the dog was breathing heavily and the customer informed my client that this was normal for the dog.

    This was a 10 year old Golden Retriever who came to my client for grooming with signs of vet work because the dog was shaved down for an ultra sound and had markings on both sides for other work to be performed. Perhaps the client failed to disclose the actual poor health of the dog and I believe in my opinion that the dog was being groomed to be put down.

    My client serves over 125 dogs a week for grooming and has a waiting list for appointments. I have never read or heard one negative review or response in regards to my clients work, performance or care of the animals they serve.

    The dog was washed and given a haircut. There is no scientific evidence that would indicate a dog's temperature rising to 108 degrees from taking a lukewarm shower.

    My client explained this to the Lund Animal Hospital when they spoke to them about the situation and at no time did they indicate that their conduct was or could have been the cause of this dog passing away.

    I would love to see the medical records of the dog and the billing which would indicate there is more to this story than what is being said.

    In conclusion, while my client and our firm sympathizes with Ms. Stolson on the death of her animal as we are all animal lovers, they are not responsible for the unfortunate passing of the animal as they did nothing wrong.

    Our firm is curious in the fact that our client was never contacted by Ms. Stolson or any representative of her before writing her report. I believe this report and this case was opened as a means to disparage our clients spotless reputation of 40 years for personal gain.

  • On or about Thursday, February 13, 2014 at 5:30 a.m. and captured on security video Ms. Cindy Stolson and an unidentified male were seen outside of my client's (Barkingham Palace) place of business where she destroyed 2 concrete dog statutes and wrote something in stone on the rug at the front of the business which now needs to be replaced. The damage was approximately $1000, Ms. Stolson triggered the alarm to the building when she tried to gain entrance through a side door and her and her accomplice ran away. We have this on video as the clients state of the art video system is crystal clear and have stored it. The incident was reported to the Delray Police Department (Case No: 14-2125) and can be obtained by calling 561-243-7831.

    "The client did not kill the dog. It would be impossible for a dog to die of a warm shower and a haricut.
