Statement of Claim
Claimant says:
"Today is October 30, 2012 and last week I purchase a washer and dryer from Appliances 4 less. Spoke with store manager Ryan and he advised me that the items that were advertised for $98 was not available in the store. He then contacted their sister store which is Appliance warehouse which had it available and advise me that it would be two days because it needed to be service. I agreed with the two days and paid him a total of $238.00.....(Not to mention he charged me for the 3 way prong and the vent as well) Friday October 26,2012 I had not heard anything from so i contacted the company to see what the status was with my appliances. He states that the company that was due to deliever it was not open on the weekend and that i should here something by monday. Well monday came and i still did not here anything so i contacted Ryan once again. He states that it would be tuesday before it could be delivered. I explained to Ryan that I was a full time student and that I also had a full time job and monday would be my only day that i would be available till 12:30pm. He then ask me can i leave my door key so they could hook up the equipment while I'm not home. Advised him i would not do such. I told him that if no one could make it by that time then there was no need to send anyone.He states he would have someone there before 1pm. I waited till 12:30pm and left for work because i could not wait any longer. At 1:15 the deliverly calls me and states that he is at my door. I contacted Ryan and asked him why would he send them to my house and i explained to him that i would not be there. I then made my own arrangements to have the items pick up and called them to explain not to have it deliever and that i would pick it up on Oct 30, which is today. The desk clerk hung up on me. Now today Oct 30, one day from it being a full week since purchase i still do not have my appliances. I recieved a call from the delivery guy stating that he had been to my apartment to drop the items off. I could not understand why they would still deliever and i called the night before to arrange to have it pick up. When i spoke to the deliverly service they state that i will be charge an additional $25 fee on top of the $50 fee for having to come out a third time. I have been calling Ryan for 2 days and he will not get on the line. The lady at front desk just keeps putting me on hold. I explained to them that this is no way to handle business and that i would never recommend nor do business with them again. They pretty much told me anything to get my money and from the looks of it we will be going to court. Please dont shop here it is a rip off......"

The claimant's settlement terms were rejected with the following explanation:

    "This customer came in to purchase appliances that she was very well aware of that were not ready to go and the appliances needed to continue service and that it would take two business for it to go through. Since they are closed on the weekends we would not get notification until Monday. The appliance accessories are not included with the purchase as she was also told; those were given at a discounted rate also. When she called us on Monday we got her different appliances that were ready to go and even scheduled delivery per her request before 1pm on that day for the standard rate of $50 not $75 for a same day delivery (which it was considered), the delivery waived that for her as a courtesy and as a favor to us. The delivery dispatcher confirmed with Latosha that the 9am-1pm window of delivery was good. When the delivery company arrived at 12:55pm, she was not home. The customer called again that evening and spoke with myself (Kio the receptionist) and was extremely disrespectful and began to threaten and verbally abuse me. I explained to the customer that I was not the delivery company and gave her their direct number when she would give me the chance to speak. The delivery company has a 24 hour cancelation policy and she was well aware of this Monday afternoon when the delivery company dispatcher rescheduled the delivery for the next day so she would be the first delivery. After speaking with her Monday evening she never contacted the delivery company to get the appliances off the truck or to cancel the delivery. As she was explained I am not the delivery company and she would have to go to them directly. She wanted it delivered at an exact time and I told her the delivery company uses a four hour window and that it was being delivered between 8am and 12pm because the appliances were still on the truck. The delivery company went to her house again Tuesday (10/30) before 12pm like she requested and she once again was not home. The sales representative Ryan has spoken with her on various occasions so I do not understand why she is stating that he will not get on the phone when she has spoken to him. If you’d like we can call the telephone company to get the recorded calls of her verbally assaulting myself, threatening the company and the various conversations she’s had with us. She did call us yesterday and Ryan was on the phone and I asked if she would like to hold for him or if she’d like for him to call her back and she asked to hold the three times that I went back to her. Eventually she hung up. The delivery company has charged her the fees for her scheduling the appointments and her missing them, unfortunately we have no control over them because they are a third party. We have been nothing but professional and cordial in this matter and have gone out of our way to assist this customer. She is very uncooperative and we will not pay her the $75 she is requesting for loss of time and the delivery expenses because those were her mistakes not ours. Latosha received delivery yesterday (10/31) of her appliances with the delivery company waiving the extra $75 fees she had accrued with missing her deliveries. "

  • As it sounds like the appliances were delivered, and the delivery company has waived the fees associated with the delivery attempts, this claim seems to be potentially filed against the wrong company (as it was the delivery company actually incurring the fees).
