Statement of Claim
Claimant says:
"SUBJECT $5075.65 OWED TO TOMMY THOMPSON JULY 10, 2010
I met Terry and Allen Baker at a BOND AND BOND AUCTION. They purchased several thousand dollars worth of computers. I learned they were shipping them to California and needed a warehouse to store then until they had a full trailer load. I also met Perla and Pedro who were helping them to pack and ship. I offered to let them store their purchases at my warehouse for a fee, $4 per skid to unload and $4 per skid per week storage. They agreed and after the sale on Saturday may 1 they followed me to my warehouse at the above address. They not only liked it but offered to purchase some computers, monitors, printers, pc boards, and wire I had. I accepted their offer and they left. Monday, May 3, I put 3 men on sorting, cleaning, and packing the pc boards and wire they purchased. It took 2 days to get everything ready. The shipping cartons were weighed empty and the weight written on each then filled by hand and weighed again to get the net weight. We ship all over the world and our weight must be accurate so we had our scales checked and certified by WEIGHT AND TEST SYATEMS OF BROWNSVILLE a few weeks earlier (copy of certification attached). On May 6, a truck arrive with a load of computers from another sale ( they were not on skids as agreed) and it took all day for 2 of my men to help unload. They sent help to pack the computers on 16 skids, but we had to move them with our forklift. The additional work cost us $145 plus a total of29 pallets at cost to us of $2.50 each (total of $217.50 which we did not charge them for) . We invoiced them in the amount of $5,074.65 on June 2. A copy of the invoice was emailed to Terry and she told me by phone it was ok and she would pay it. On Friday June 4 a tractor trailer showed up from NY transport to pick up everything. We had no idea they were coming as we do not ship anything until it is paid. Terry assured me our invoice was ok and she would pay it so I let my men load the truck. (a very bad mistake).
I meet Terry the next day, Saturday, June 5, at another BOND AND BOND AUCTION , where I gave her another copy of our invoice. She said she would go to the car and get me a check. Later she returned to tell me Allen said he was wiring the money Monday. The money never came and I tried to call her everyday and sent emails everyday. She only answered me the one time and I have never been able to reach her. I have emailed them that if they did not pay I would sue.
I meet Terry an another auction Saturday, July 10, where she purchased over $4900 of computers and paid cash. I asked her for the money she owed me and she refused to pay. I tried all day and she would turn and walk away and not even talk to me."

  • These folks are now using ebay to sell computers. Selling broken, incomplete or "below spec" machines. I have notified ebay of this case and their other criminal records.
