Statement of Claim
Claimant says:
"Hand delivered December 2013

Trevor Balcharan:

Due to failure on the part of contract agreement to complete the guest bathroom for the above residence within not only a timely manner: (2 weeks, perhaps 3); but also failure to complete said contract to customer satisfaction. It has been one year since the job was started.

Listed below are the following reasons of complaint:

1. Consistent failure to keep set appointments in a timely manner after repeated cancellations as well as No Call/No Show of set appointments over the period of 10 months.
2. Granite installed was not what had been chosen by the customer; the backsplash does not sit flush with the countertop. {it is short by 1/2 inches}.
3. The customer was charged for shower wall tear out. Said wall had already been torn out & awaited beginning construction.
4. Incomplete floor installation. As yet, the floor is unfinished for grout around the edges.
5. Failure to finish proper caulking around shower door as well as window.
6. Failure to properly complete holes torn in ceiling & left in wall above sink. The customer had to do the physical repairs for said holes.
7. The Customer was unadvised as to the extent of expected supplies for all necessary items for the job. This includes grout; joint compound; sheet rock; caulking; and tools. According to the contract; Customer was ONLY to supply tile; wood flooring; faucets.
8. Failure to properly seal the toilet, which leaks.
9. Failure to properly seal the floors around the walls in both bathroom and kitchen. This has resulted in a continual onslaught of issues with ants.
10. Failure to properly set the tiles in the bathroom shower.
11. Failure on the part of granite installers to advise customer regarding the plumbing in the bathroom. Due to negligence there was water damage to items under sink in bathroom cabinet.
12. Customer was charged for a bathroom cabinet; which changed when customer then had to go to Home Depot to purchase.

Close photo documentation of all stages of the remodeling process has been kept & is saved to files, along with all receipts of monies spent for both bathroom & kitchen.


A copy of this letter has been sent to Better Business Bureau; & will be retained for the Customers' files.
Failure to acknowledge & comply within said time frame for this request will result in the pursuit of necessary legal procedure.
