Statement of Claim
Claimant says:
"Alarm system which is over 3 years old started sending smoke detector alarms randomly.
Numerous attempts by ADT to correct the problem over 6 months from the fall of 2017 to the spring of 2018 resulted in my termination of ADT service because of their inability to solve the faulty alarm problem.

New alarm company was able to solve the problem on their first trip by simply replacing the entire smoke alarm sensor, which I gladly paid for.

Now ADT wants $659.49 as a "cancellation fee" .
BEWARE OF CANCELLATION FEES THAT ARE NOT DISCUSSED OR IN WRITING IN PERSON !!!!
I have no contract with ADT that says anything about a cancellation fee. If I did, I would submit that the cancellation fee should not apply if alarm can not be repaired to perform correctly.

I believe that I have paid ADT for all of the service that they provided.
Please see what can be done to credit this account for the amount of $659.49"

"Actually, since ADT did not do their due diligence to correct the faulty sensor and you were forced to pay another company they should refund you the cost of that what was paid out to another company to fix a problem they refused to fix due to their negligence. They breached the contract that they had with you and refused to service their own equipment and did not take responsibility for their faulty equipment.

Whether or not their was a cancellation fee, they breached the contract for 6 months thinking they did not need to act on this problem that is their responsibility to a customer that "in good faith" tried to rectify this issue and nothing was done to help solve this issue.

I did feel you should not be forced to pay a cancellation fee due to their negligence on this issue and not taking responsibility for their products that are meant to help people and possibly save a life due to this company breaching their duty to fix this in a timely manner."

    I do feel ADT did breach any contract they held with this customer. The customer in "good faith" tried to have this issue fixed and ADT breached the contract when they did not do any repairs on their own equipment. I also feel the customer should be refunded the amount he paid to have this issue fixed by another company since ADT abandoned their responsibility to service their equipment in a timely manner. A contract is only as good as the claims behind it, therefore this contract was breached due to ADT failing to correct this issue at anytime it was repaired by another company. When a company holds a client to the terms of the contract while they are held without harm is a one sided contract where the client loses and the company wins without putting"due diligence" into said contract. Without a fair contract, it is as if there was really no contract at all. Unless the terms of a contract is fair to both parties, then there will always be a unfair standard for companies to take advantage of consumers. Their negligence to fix this issue could have had terrible consequences, fortunately it did not. But, to expect a customer to follow the contract while the company plays the blame game is just an undue burden that this company tried to force on this customer and breached the contract with said customer.

    If ADT was unable to correct a sensor problem that caused random false smoke alarms, it should not charge its customer a cancellation fee. ADT should also learn from its errors - including the failure of accounting and customer service to communicate. More...
