Statement of Claim
Claimant says:
"i was promised a subcontracting job from one of their employees, benjamin howie. i packedup and moved to north carolina from massachusetts. took a two person crew to do roofing and siding for this company. upon arrival benjamin howie refused to return my calls where up until 2 days before i left we were in contact.
benjamin never told me his company had stopped doing installs for the lowes corporation. i am out $15,000.00 dollars on account of his deception.
the legal term for this is called 'detrimental reliance', i feel restitution of my moving expenses and lost wages for myself and my crew are owed.
called a tanya shaffer from service pros and she basically laughed at me."

The claimant's settlement terms were rejected with the following explanation:

    "The first time Steve Dawkins contacted our office staff was on October 29, 2014.

    Prior to that time he had only had communication with one of our field project managers. He has never filled out any employment or subcontractor paperwork with our company and has never received a formal job offer from our company. He replied to a Craigslist ad for subcontract roofing and siding laborers a couple of months ago but lived 800 miles from the location of the work. He said he was relocating and our project manager said that when he got here we would love to work with him, thinking he meant he was relocating immediately. He was emailed the paperwork we would require to be filled out for a subcontractor applying for work (Application, background check forms, Subcontractor Agreement, etc...) but our company did not receive any paperwork back from Mr. Dawkins.

    Nobody from our company heard from Mr. Dawkins for several weeks and then at the end of October he contacted us demanding work. Ben Howie told him that there was no longer work available, that the work advertised had already been completed by others and we no longer had a need for Mr. Dawkins services.

    In the construction field, labor demand is highest in the summer months (when the work was advertised) and diminishes in the fall and winter months.

    October 29, Mr. Dawkins contacted me and said he had been in the area that the work had been offered for a few weeks now (Raleigh, NC) and wanted to start work but had called Ben and been told that there was no work. He was angry. He called our office because he had been calling the project manager and even a client of ours and had not been able to get a call back from anyone willing to give him work.

    I explained that when we ran ads this summer we needed workers at the time the work was advertised and that we no longer needed to hire anyone for the services he offered.

    I did tell Mr. Dawkins other places to look for potential work but he told me he had already gone back to Massachusetts and wasn't in NC any longer. I then suggested he look for work in Massachusetts where he is located, but he was very angry and did not want to hear any alternative suggestions. His only desire in the call was either a job offer or someone to pay him for calling and texting about a job that had been advertised a couple months ago, but he had not applied for.

    We wish Mr. Dawkins well in his search for employment but unfortunately our company does not have any positions available in Mr. Dawkins area of expertise at this time."
