"Below you will find a letter sent to: Amber Waswo, Owner, CFO
Matt Waswo, VP Operations
John Suarez, VP of Business Development

My crew and I were hired to do this job, no contract and we have not been paid for the 14 days of work to get this site ready. In this industry you hire and your word is good and after a week of not being paid anything for gas and etc. we couldn't afford to drive back and forth to the job. I was promised repeatedly that money was coming or being sent and on and on. I have sent certified letter, demand letter and Intent of Lien and every one was denied and returned. We the Intent of Lien was sent by a legal firm the Owner and Wife of Matt Waswo denied knowing him or of me. I have learned that this company owes many many tower crews and companies and is being sued. I need help to pay my crew..

This letter will serve as formal notice to Western Tower Services LLC that you are in default of your obligation to pay the sum of $9720.00 (nine thousand seven hundred twenty dollars) for work done on jobsite Sundowne Glenn in Houston, Texas from March 29, 2016 through April 15, 2016.

You have failed to pay despite repeated requests by myself and for my crew, Josh Lee, Robert Roup, Hiram Lopez, Zane Sabido and Joel Sabido. We worked for 13 1/2 days which is equivalent to 136 hours. We have never been paid for services done at this jobsite.

A completed daily worksheet was emailed to Matt Waswo and John Suarez on April 22, 2016. Over the past 3 months I have sent countless emails, text messages and made phone calls to John Suarez after Matt Waswo insisted that John Suarez handle this situation. I was promised payment for me and my crew last week that payment would be made when the check cleared your bank.

As of to date, check has cleared and now I am being told by John Suarez I must talk to Matt Waswo about being paid. I called 20 times today, no answer.

Unless payment of the above amount is received by us in full ten (10) days of this letter, I will have no alternative but to exercise whatever rights and remedies I have under the law to enforce such payment, including but not limited to institution of legal proceedings against you and your company to recover the above amount, together with accrued interest and legal expenses.

NOTE: Matt Waswo and I had an agreement set up to get this job started. He told me that was going to lose the site if he didn’t get a crew on site. I was only hired to do civil but ended up doing some tower work as well.
