The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Claimant purchased a used car and was given opportunity to have vehicle checked by her mechanic before purchasing. No warranty was given and claimant signed documentation to support this. Unfortunately, we have NO control over the mechanical aspect of this vehicle and do not offer a warranty for any used cars or trucks that we offer for sale. If the manufacturer warranty exist, the balance of that warranty may cover a vehicle in which we may sell. This vehicle is a 2003 and the customer was aware the vehicle had NO warranty. We did try to send her to a mechanic to check this vehicle, but they were unable to find the problem. Since this vehicle is a Land Rover, we have no mechanics that are familiar with this type of vehicle in our geographic area and the customer was advised of this. We are sorry for her trouble with this vehicle, but have NO control of the reliability of any vehicle that is used. "
