Statement of Claim
Claimant says:
"We are 70 and 79 years old. We fell for a pitch from a door-to-door salesman for Vivint. They installed equipment which they never explained and failed to supply necessary tools. ie sensors on their thermostats which were to be used to remotely control heat and cooling but we didn't know we even had these and never received the remote controls to operate them - but we have been paying for them. The $70 should also have covered outside cameras which we never got.
We called to cancel the services, after two years, when we heard a presentation by local policemen recommending two local companies for security, charging 16.95 Smithe Johnson and 27.95 ADT. Vivint claimed we signed a 5 year contract; which we did not. They sent a 5 page contract over the email, which I had never seen before, claiming the signature on it was mine. I sent several copies of my signature to refute that these signatures were the same. I saw their salesman only once and had the contract I DID sign with him that day with no reference to a 5 year contract.. That they can have another contract that they have someone sign and then claim you signed it, is amazing trickery.
I stopped the automatic payments at my Credit Union so they changed the monthly amounts twice and were successful in getting their payment through. I had sent official stop payment documents supplied by the Credit Union to both Vivint and the Credit Union. When I complained, the CU said that was illegal on their part and they pursued Vivint, got back the 2 payments and reimbursed us. I had to close that account and open a new one to prevent future fraud.
Then they illegally charged my Mastercard for the monthly payment. I had to go through
refusing payment on that charge and got it reimbursed.
I have written numerous letters stating that we were canceling their services. I have spoken to many agents, people in the billing department, and miscellaneous representatives and they refuse to admit that we did not have a contract.
We have even offered to continue if they would lower the monthly payments to a more fitting level based on what was available in our area and what special equipment we did or did not have included in our service. We suggested $30.00 a month for the basic service we have, which is still well over the $16.95 we would be paying to our local Security Company, but they have refused to work with us. Short of having someone who services our heating system come to remove their thermostats and replace them with ones like the original ones we had, this system continues to be in service in our home and they continue to bill us.
How do we get rid of it and them?
