Statement of Claim
Claimant says:
"On 12 Aug 2011 Spencer Olsen came to my house telling me about the Vivint alarm system and how it is better than ADT because it is wireless and how someone on my street had their house broke into and the wire was cut so the alarm did not work and they also said their system would cause your electric bill to go down. I was very sick that day and I wanted to wait for my friend to come over to help me out with this but Mr Olsen was very persistent and I thought you were supposed to get 3 days when transactions like these are made. He wanted to use my bathroom, then he wanted water and then he was making comments about how nice my house was. The next thing I know a technician was at my house installing their equipment. About 2 weeks later my house got broken into and he had made a comment to me that people don't break into houses with alarms. (How does he know that)? He did not have the contacts listed the way I told him and he did not put down my cell number. It seems mighty strange that nothing like this has ever happened since I have been here(13 years) so I told Vivint I wanted to cancel their services and I was told that I could all I had to do was turn in a police report."

    Unfortunately I really don’t see any violation here, maybe deceptive business practices, but no real violation. I would also venture to say that one of your neighbors most likely did not have there house broken too. Also, the three day right to cancel was voided once the equipment was installed, again not a violation just bad business practice but very common for Vivint and others company with the same business model. Up until I think last year, Vivint and other companies like Vivint sold all there contracts to ADT or a company called Monitronics.

    I have checked the states website and see two different Spencer Olsen’s that have a Utah State Alarm Agent licenses. What city do you live in as they may have a license requirement to sell door to door and you may find a violation if he did not get a peddlers permit.

    One of my biggest concerns is the actual break in 2 weeks after the system was installed. Did the police talk to this sale rep concerning the actual?

    As the Secretary of the Utah Alarm Association I would like to discuss this in more detail to see if maybe something else was said or done that could be a violation of state, city or county statue. The association works very closely with our members and Vivint is a member of the Utah Alarm Association.

    As far as lost time goes, no court, law, or ordinance if broken or violated will provide you compensation for lost time.
