Claimant says:
"I purchased a 2002 dodge minivan handicapped, as is. They did not tell me the van was rusted out on bottom of van, I took it to a handicap shop to have e lock moved to a new place. The dealer said he would not drive it, it was dangerous to drive. I asked victory to take it back, he said you bought as is."

  • There is a Consumer Protection regarding used cars in Ohio called the Consumer Sales Practice Act. Information can be found at Ohio Attorney General's site and you can file a claim online. Or call 1-877-607-6400. See if they can help or refer you to someone that can help.

  • Due to the “as is” nature of the sale, it was unfortunately your responsibility to inspect the vehicle for potential defects or repair issues. If you did not discover the rust damage prior to purchasing the vehicle, it would be your responsibility for repairs to the vehicle.

  • State laws hold dealers responsible if cars they sell don't meet reasonable quality standards. These obligations are called implied warranties - unspoken, unwritten promises from the seller to the buyer. However, dealers in most states can use the words "as is" or "with all faults" in a written notice to buyers to eliminate implied warranties. There is no specified time period for implied warranties. You may also file a complaint with the Better Business Bureau in your area.
