Statement of Claim
Claimant says:
"Andrew Baer of Veterans United Home Loan filled out an application for a mortgage loans without my knowledge and consent. Mr. Baer processed the application without my knowledge and consent. Mr. Baer sent me paperwork stating that my "application" was declined because it was incomplete. While conversing with Mr. Baer on the telephone the day in question (on or about September 7, 2014) concerning an inquiry about mortgage loan, he began asking questions. When it came to my social security number, I informed Mr. Baer that I do not give out my social security number. In my opinion, Mr. Baer became more aggressive, and at that time I told him that I was not interested in doing business with his company, Mr. Baer become even more aggressive, and I then hung the phone up. In my opinion, Mr. Baer turned an inquiry into an application knowing that the "application" was incomplete, and would result in a denial, for retaliatory purposes."

  • On or about September 2, 2014, Mr Andrew Baer, an agent of Veterans United Home Loans, failed to disclose a material fact, that he was filling out a loan application for my wife and myself. Mr. Baer had a duty to disclose that he was filling out the said loan application. This is a material fact because Mr. Baer had a duty to disclose that he was filling out a loan application at that time. Mr. Baer knew that we had no knowledge that he was filling out a loan application, and could not object to it. Mr Baer knew or should have known that he had a duty to disclose this material fact, but, failed to do so. By failing to disclose the material fact Mr Baer deprived us of the opportunity to consent of deny consent to the application being filled out. We relied on the failure to disclose, and in doing so could not object to the application being filled out. We were injured because the application resulted in a denial of approval for credit, which could impact our credit, negatively, when applying for credit elsewhere, and could lower our credit scores.

    "In September of 2014 this complaint was addressed through the proper banking authority and has been closed by the regulator. We again apologize if any statements were made in an aggressive manner. This is not the way we would intend to treat the heroes of this nation. We have helped tens of thousands of Veterans into homes and donated millions to military families and organizations. Based on a specific request for resolution, we provided a certified letter acknowledging that no application was provided, no credit check was performed, no information was translated to the bureaus or would blemish a credit profile. The delivery of the Notice of Action letter for "incompleteness" was in full accordance to federal laws and requirements. The complaintant lost no money during this exchange and a $2,025.97 settlement or compensation in any amount would not be appropriate."
