Statement of Claim
Claimant says:
"Upscale Resale is a consignment furniture store in Saranac Lake, NY. Last September, the owner - Denny Ford - bought several pieces of furniture from me, gave me a downpayment in cash, then wrote a promisory note for the remaining amount. Despite many promises to the contrary, since I moved to Colorado he has not sent any additional money. Recently he stopped answering my phone calls, so I have filed civil suit with the Saranac Lake Village Court. I am asking for the amount owed, plus interest / month and court expenses."

  • If the owner of the shop gave you a promissory note, that is something that should absolutely be able to be enforced by the court that you filed the claim in. Have he responded to the court case in any way? You stated that you had been in contact through phone, but have you ever tried contacting him in writing in a way that can be traced (for example, via certified mail)? Perhaps proposing some terms for repayment may be an easier route for you to get repaid the money that you are owed, and allow him to make payments on the debt without having to pay a large amount at once.
