Statement of Claim
Claimant says:
"Our 2003 Toyota Highlander was purchased new from Cavender Toyota and serviced primarily at Universal Toyota service department. First, Universal Toyota service knew of a manufacturers recall for engine sludge, yet over several years of service they neglected to check the engine for the sludge problem. Considering Toyota's reputation for reliability and dependability, we expected nearly 250 thousand miles of service from a well maintained car. Due to Universal's incompetence and shoddy service, however, the engine succumbed to the sludge issue after only 125 thousand miles.
Additionally, when Universal's service dept was directed to perform regular service prescribed by Toyota's mileage chart, they neglected to change the transmission fluid, leaving the old fluid to go bad, setting up the transmission for certain failure.
Furthermore, the car was returned from regular service with what appeared to be an engine oil leak from the drain plug. We were not notified that a problem existed; it later proved to be a leak in the rear main seal and a very major and expensive repair.
Finally, we asked Universal to serviced the car in preparation for a trip to Denver. The car showed no problems during our 1 to 2 mile drive home. The next morning, however, during our first stop from normal freeway speed, the car displayed a terrifying high speed shuddering and chattering from and unreported brake problem.
We truly loved our Highlander. We still miss it to this day. We'd love to have another one. We did not and do not ask for a NEW car. We did ask for another car, another Highlander. Instead we were offered $500.00 off the price of a new car. What a cheap cheat!
We do have a file full of service records to support our claim."
