Statement of Claim
Claimant says:
"I hired Mr. Robinson to make some repairs to my rent house. Included painting, repairing area in bathroom and wall paper. Also was to replace light switch plates. Mr. Robinson advised that the job was complete. The hallway walls were beginning to mildew, not sure if it was the lighting, but looked okay to me. I failed to look in the bathroom to see that job was not completed. The next day I went back to the house and did another walk thru and noticed many repairs were not made. I phoned Mr. Robinson and advised him of repairs not completed. He said that in a few days he would stop by to pick up his kitchen cabinets he left, I also wanted a bid on kitchen cabinets. Anyway he took the bathroom tiles and did not make any repairs. I phoned him again and all he wanted to do was yell at me when I told him how disappointed I was. I told him the job was not worth the money I paid him and he needed to return the tiles and refund me some money. He told me he would bring tiles a week ago. I have yet to hear from him. Hopefully there is something that can be done because this man really took advantage of me financially. He was aware that my tenants were going to be moving into the house over Spring Break. I had to hire someone else to make the repairs, so I am out double. He should not be allowed to work in this area."

    Explanation of work performed !
    Treated walls for mold plus removed it. Repaired holes in walls.Repaired damage to walls from mold caused from leaky roof. Applied KILZ Premiere to ceiling to cover stains from leaky roof and walls. Painted 2 coates on walls in 2 bedrooms and large hall and Vestibual.Mold will not go away unless sheet rock is replaced . Roof leaking is the problem Marilyn Brown has 30-35 year old roof . The shingles were originally a 15 year life age and hail damage. I gave Marilyn Brown 2 estimates on replacing her roof. One for asphalt shingles second for a metal roof. Mrs. Brown declined to replace the roof because could not afford new roof. Her problems with interior wall will not go away until roof is replaced. New carpet and paint will not stop mold from coming back only replacing the roof will. Their have been 2 heavy rain storms of 1" or more since the work was completed a month ago. What Mrs. Brown is seeing now is mold growing back on the walls or bleeding through the paint. Mrs. Brown and I did a walk through on completion of the work and paid me the final payment of $ 800.00.

  • In response to Mr. Robinson's reply, I want to thank him for breaking down the costs since he did not supply me with any detailed invoices. I stopped or drove by my Dad's house several times on the days the guys were working. I question the fact that they worked a total of 24 hours each.

    During my first visit with Mr. Robinson, I advised him that I had new tenants that would be moving in during Spring Break (March 11-15th) and needed the inside repairs to be completed before then. I showed him the walls that needed work. He advised me that the walls in the hallway and in the master bedroom needed to be treated for mold. We agreed that the holes in the master bedroom where the bed had been would also need to be repaired . KILZ would also be applied to walls and ceiling in hallway bathroom and walls would be painted. I do not recall anything being said about replacement of the sheetrock.

    I also communicated to Mr. Robinson that I wanted the missing light switch plates replaced, wallpaper reglued in master bath and also on corner of wall in master bedroom by closet, and an area behind the commode in the hallway bathroom that needed to be repaired. These repairs were not made.

    I trusted Mr. Robinson, so when we did the walk through I assumed that all requested repairs were made. The next day I did another walk through and noticed streaks on the walls. It looked like someone started painting at the top and then stopped halfway down. The paint job looked horrible so I asked another contractor for his opinion. I was told that it looked like maybe only 1 coat of paint was applied.

    When I phoned Mr. Robinson to discuss the repairs that were not completed and mentioned that I was not happy with the paint job, he became defensive and did not like the idea that someone else had questioned his work.

    During my first conversation with Mr. Robinson, I told him that I had inherited my Dad's home and would also need a quote on a new roof. I advised that the carpet would be replaced and inside repairs would be made first. Then I would have the roof replaced.

    My Dad's house was built in 1988 and I am aware of the roof condition. There were two obvious leak areas, one in the master bedroom and the other in the hall bath. Mr. Robinson gave me 2 different bids on the roof but I never declined. I wanted the inside repairs to be completed. Another thing I was also requesting estimates from several other roofers and I wasn't going to reveal that information to Mr. Robinson, it was none of his business. Plus the fact his bids were quite high.

    I am totally aware that a new roof is needed, but I am intelligent enough to know that mold would be growing back or bleeding through the paint after two days. Mr. Robinson mentions 30 days but he is mistaken, because I called him a couple of days later, not 30.

    Mr. Robinson phoned me shortly after my discussion with him. He explained that he had been busy and wanted permission to pick up some cabinet samples he had left at the house I gave him permission and assumed that he would take a look at the paint job and other issues I had.

    I called Mr. Robinson once again since I did not hear from him to ask when the repairs would be completed. He told me that he was busy and it would be another week. I mentioned that my tenants wanted to move in during Spring Break. He said that he did not remember me teling him that. I also mentioned that the 3 original bathroom tiles were missing and wondered if he took them. He admitted that he had taken them.

    Again he became defensive and started raising his voice and I could hardly get a word in. I became upset and told him to please return the tiiles and that I would just get someone else to complete the work he failed to do. He did advise that he would return the tiles. As of today I have not heard a word from him nor have the tiles been returned.

    I am not satisfied with Mr. Robinson's reply and explanation. I still feel that he should refund some of my money and definately return the tiles. As I mentioned these tiles were the originals and I doubt very seriously if they could be replaced.

  • Chuck - I want the original bathroom tiles you took returned immediately. I hired someone else to complete the repairs that you failed to finish. Since you have made it obvious that you don't want to deal with me, you can drop them off during the daytime hours. Also my tenants have moved into the house so you can also leave the tiles with them. The area in the guest bathroom has been temporarily repaired. The tiles are needed to complete the repair.

    Chuck, after our first meeting, I felt that I could trust you, but you proved me wrong. I hope you can live with your conscience knowing that you scammed me. I would never allowed you to enter my Dad's house to get your cabinets, if I had known you would take the bathroom tiles and never return to finish the job.
