Statement of Claim
Claimant says:
"January 2018, I paid Transmission Expert to replace the transmission in my 2009 Honda Accord. I advised Eddie, manager, that 2009 Honda Accord has 2 transmission. I provided Eddie the Transmission number that was provided by the Honda dealer that needs to go into my 2009 Honda Accord. I asked Eddie to ensure he is order the correct transmission.

Over the next approximately 2 months, I have taken my car back approximately 6 times due to my car not shifting and the "D" drive light blinking. On 1 occasion Eddie advised me that he was ordering a new transmission and 1 occasion John advised that he was ordering a new transmission. The last time my brother took a picture of the transmission and it was determined that a new transmission was not ordered for my car but I was being told to keep my car at the shop while they order a new transmission. On the 2 occasions that a new transmission was ordered, I was told a new transmission was ordered.

On the 2 occasions I left my car with Transmission Expert to get a new transmission , they kept my car for approximately 7 days each. During both times, I had to rent a car, incurred expenses for renting the car. It is very upsetting to know I incurred rental car expenses when Transmission expert never order a new transmissions but my car was there at the shop the entire time. Total unprofessionalism.

Both Eddie and John told me that they were ordering a new transmissions and both times they both alleged the new transmission would be in around Monday and Tuesday. These were both false statements because they both knew they had zero intentions of ordering a new transmission. The last time John advised my brother and I they he felt the 3rd transmission would be the transmission to repair my car. Again- John had zero intentions of ordering a new transmission.

I continued almost weekly, take my car to Transmission expert with the same issue- "D" light flashing and car not shifting properly. In an effort to assist Transmission Expert, I took my car to the Honda dealer twice and incurred expenses of approximately $400. The first time Honda advised the trans fluid leaking out and transmission axle keeps popping out of the tranny. Honda replaced the axle seal , torque converter clutch and added transmission fluid. With in 5 days the same issue occurred -"D" light flashing and car not shifting properly. Honda complete an diagnostic, which I had to pay for, and advised me to take the car back to the transmission shop because they put a bad transmission in my car or the wrong transmission. I took all the Honda paper work to Transmission Expert. I wanted to partner with Transmission Expert in resolving the issue.

I became very frustrated because I had been taking my car back to Transmission Expert with the same problems and no results in repairing my car. I called my brother and asked him to come to Columbus to help me work with Transmission expert on repairing my car/transmission.

In an effort to assist Transmission Expert in putting the correct transmission in my car, my brother did reach and talked with the Honda Dealer. It was determined that Transmission Expert put a B90 transmission instead of B97. My brother, advised transmission expert of the correct transmission.

Transmission Expert only replaced the axle seal. I advised Transmission Experts they have replaced the axle seal twice and the axle seal is not the problem. On 3/15/18, I picked up my car and was told tha the new transmission was in my car. We showed Transmission Expert a picture of the transmission before they replaced and picture of the transmission after they replaced -it is the same transmission."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

"MS Johnson is correct in one aspect they did make a b90a transmission and a b97a transmission for honda accords that year. THE b90a transmission is for a 4cyl and the b97a is for a 6cylinder transmission. The vin for Ms Johnsons car is 1hgcs12379a019478 which is a 4cyl vehicle. The b97a would not even bolt up to her engine. Ms Johnson is more than welcome to bring her car in and we will check for any problems and go from that point. "
