Statement of Claim
Claimant says:
"My neighbor and I shared a tree on our property line. We agreed to contract someone to take the tree down since we were concerned the tree may fall on the homes if a bad storm hit the area. My neighbor contracted The Tree Man on 03/15/13 to take down the tree. After several days and not having heard from The Tree Man, both my neighbor and I placed several calls to him but were never able to reach him. Approximately 30 days later the crew showed up without a notice. While on my property, their bucket truck caused cracks on 2 different sections of my concrete driveway and a section of concrete in the backyard. It took him a month to contact me about the damage. We agreed that I would obtain some estimates and he would repair/replace the damaged concrete. I got 2 estimates and faxed them to him as per his request. Many phone calls have been made to him in failed attempts to reach him. 2 weeks ago I was able to get in contact with him. He stated that the estimates were too high and that he was going to contact someone he knew to give him another estimate. I requested that he let me know who he was contacting and when they were coming to do the estimate because I would like to be home, besides I explained to him that I did not want anybody on my property without my knowledge. He said he would never do that. But I have documented 2 separate ocassions when I received a phone call from my neighbor telling me that somebody was on my property. First time one of his worker and the second time, himself. These 2 incidents took place several days after the tree was already taken down. Today 05/22/13 I got in touch with him. He said someone was already out on my property but he was waiting on the estimate. I reminded him of our previous conversation about not having anyone on my property without my knowledge. He claimed he did not remember that conversation. I asked him for the name of the contractor he had ask for the estimate and he provided me with a name. He said he would contact him and find out what was going on. If specific dates are needed, I have documented all the dates for every phone call I made to The Tree Man. I also have saved his voice messages to me promising he would take care of the problem and also documented the times when there was somebody on my property. I just want to know, do I have the right to choose the contractor myself. Can I just ask him for his insurance information and summit a claim directly to them. He is the owner and I am worried that if I press the issue, he can just refuse to take care of the damage. I just want to have this problem solved and me not have to deal with this guy. I have worked with many contrators and PROFESSIONALS and I have never met anyone with such questionable work ethics. I am tired of waiting and chasing after him. Please tell me what I need to do. How can I take care of this problem?"

  • The Tree Man contacted me on Tuesday 05/28/13 to let me know that he was aware of me filing a claim with PeopleClaim. He said he would pay for the fees and that he was working on contacting other contractors for estimates. He gave me the name and number to a local contractor. Tim said that the contractor could meet me on 05/28/13 at 5p. I called the contractor and left a message telling him I will make sure to be home by 5p to meet with him. I then received a message at 6:45p from the contractor saying he could not make it. As of today 05/31/13 no one has contacted me or scheduled a time for an estimate.
