Statement of Claim
Claimant says:
"My name is Gerald Erwin. In late May of 2015 I purchased the house at 6171 Point West Cove in Bartlett Tennessee from Tennessee Investment Properties in Memphis Tennessee. The process of buying the house was halted due to the fact the inspector found foundation issues. The problem was supposedly fixed and the process continued.

This past spring during the rains of 2016, I noticed walls around the house were cracking. They were small hairline cracks so I thought that it was no big deal. I filled the cracks and repainted the walls. During the fall the cracks returned. I used a dremel tool and grinded the cracks out and refilled the cracks therefore creating a stronger bond. Then I repainted the walls once again. It is now January of 2017 and the cracks have returned. It is then I realized without a shadow of any doubt that the contractor that they used just filled the cracks in the walls and repainted the entire inside of the house and the outside face of the foundation was covered with a thin layer of concrete to cover up the visible evidence so the inspector would believe the problem was repaired.

I tried to resolve the problem with the company myself but they just blew it off. They said if you extend the spouts on the gutters out and keep the water away from the foundation it should fix the problem. I was very upset. I talked to the inspector that did the inspection. He had no idea they had fixed the walls and repainted so no damage would show. They knew exactly when he would come out and covered the damage. I also have an appointment with Olshan on March the 2nd to get an estimate on the repairs. The repairs will be extensive for 10 walls throughout the house are affected. It is the entire foundation and not just a section. I am trying to resolve this without going to court but if I must I will be going for much more."
