Statement of Claim
Claimant says:
"On Dec 18. 2013, I signed a contract with Tate Publishing at which time I gave them $3,990. On Jan 22nd 2014, I gave Tate Publishing another $1000.00 a rush fee to get my book published in 90 days, that Mr. Ryan Tate himself signed. On April 18, 2014 I received the editing back, after letting them know the 90 days were up. I was given until May 14th, I believe, to make changes. I felt as though the editng was poorly done, so I had to pay another editor to ck the manuscript. I was told it was bad and needed re-work, but the person didn't have time to get it done right then. Anyway, I made changes myself and after I was through I had no one to read it for me. I read it twice and thought it sounded okay. I signed the approval form July 10th and faxed it. I was still waiting to get a bk, but my patience had run out. I called a friend who works for an attorney. He had me come in so he could read the contract. He wrote Tate Publishing a letter July 18th and requested that I get my money back, since they didn't come through on their contract. Since I didn't get any reply I wrote an email. I was told they never received a letter, so the attorney's office faxed it on the 28th. I also wrote a second letter asking to have the contract terminated, because I wasn't happy. On the 18th I gave Tate Publishing $500.00 for a shipment of 50 bks. Yesterday after looking at my manuscript I saw a mistake and aksed Tate to stop production and refund my money back. I was told they don't do that. My book is listed on Tate Publishing site only, not on Amazon, kindle or e-bks. I was told that wouldn't happen until November. Tate has ignored ever attempt I made to cancle this contract and has refused even to compromise and give me back $3,500. I'm on SSI for an accident I had and some of the money I gave to Tate was from that. I can not express my frustation at this time. I cry when I think about it. In the contract from Tate section VI 8. It states either party may terminate this contract with cause. I tried and have been ignored on all counts. They make so many excuses, I don't know what to do next. Please help."

  • Additionally, it should be noted (contrary to Ms. Brumfields' post) that no attorney has ever contacted Tate Publishing on behalf of Ms. Brumfield. If they did, or would like to in the future, then we would welcome a conversation with them. Also, no publisher ever promises instant success, or that books would be available at every brick and mortar location as Ms. Brumfield is incorrectly stating. There are over 3,000 books every day released into market and that statement is simply impossible. Again, we are sorry to hear of her troubles but these accusations are 100% false. We wish her the best, and hope she finds what she is searching for.

The claimant's settlement terms were rejected with the following explanation:

    "We are very sorry for Ms. Brumfield's troubles, but we stand by the work that our team has done on her book. Our production team has met each of her requests, and Ms. Brumfield signed off on the book with her full stamp of approval. It is not uncommon for authors of any publishing company to see things they would like to change, and we offered a route for Ms. Brumfield to make adjustments to her manuscript even after she submitted approval. Instead, Ms. Brumfield decided to cancel the contract and book purchase entirely and without notice. The contract and approval forms that Ms. Brumfield signed were very clear and she understood them all at the time of the signing. There has been no evidence of violation of the contract. If Tate Publishing were in violation then we would be the first to correct the situation, as we will always abide by the signed contract. Ms Brumfield cancelled her contract with Tate Publishing prior to her book release date, therefore Tate is under no obligation to represent her book in distribution or submit to same. We are very sorry that Ms. Brumfield feels "cheated", but she signed up for a service that was provided, and then it was voluntarily relayed to our staff by Ms. Brumfield that she regretted such a large purchase since she is on a monthly income and she needed the money back, despite the contract that she voluntarily signed. We believe this is simply an issue of Ms. Brumfield needing money and Tate Publishing is being unfairly targeted and accused. If Ms. Brumfield would like to renew her contract with Tate Publishing, we can certainly look at meeting her in the middle on her book purchase, and replacing half at no cost to her. We are under no obligation to do so, but simply want to make sure our authors are taken care of."
