Statement of Claim
Claimant says:
"I ordered a men's cassock black robe for my husband along with the other ministers in my church back on May 4th. We all received the exact robe except my husband's was too big. I called Suit Avenue and asked them what I needed to do in order to get a smaller size. I was told to send the robe back and put a note stating I wanted the same robe just a smaller size plus they needed another check for shipping. A week later when I didn't hear from them, I sent an email requesting the status. I received an email backnstating that they had to special order it because they didn't have it in stock. Another week later, I sent another e-mail to find out the status of the robe. I didn't get an answer back, but instead on June 9th I received a package supposedly with the correct robe but when I opened it, it was the wrong style.
I called Suit Avenue and left a message that day on 9th June. No one returned my call. On today, June 11th, I called again to tell them that I did not receive the original robe that I previously ordered. I was told by an an employee that they sent me what was available. I told her that I did not want what they have available but I wanted the robe style they originally sent me. She then asked me what was the difference? I told her that the original one had buttons done the arm of the robe and the sides but this one was just plain without buttons. She then told me that if I wanted buttons, I can send it back but I have to pay for the buttons. I told her does she realise how absurd that sounded and she kept insisting that the robes were the same anyway even though the one they sent me had no buttons and the original did.
She then asked me if I wanted to speak with her manager whom she had apparently spoken to before he came on the phone because his attitude stunk from the beginning. I told him the situation and then he told me that the original robe I had ordered was discontinued and so they sent me a sustitute. I told him how could they do that when they told me that they were special ordering the correct size for me in the original order. I told him that they lied to me then send me the wrong robe thinking that I was stupid enough not to recognize the difference. He said to me that I was the one being impossible and that if I didn't want the robe to send it back and that I will get my money back minus the shipping costs and if I kept on arguing with him he will hang up on me. I told him if that is the way they are doing business with the public he needed to get some customer training and know how to speak to his customers. Plus I informed him that I was going to file a complain with the BBB since they have on the site that they are part of the BBB. I am furious because now my husband is the only one with a different robe in the group and it amazes me why these people couldn't see the inconvenience they have put us in. This robe is for a special occasion on June 25th and all these people could say is that they are sorry but there is nothing they can do about what happened. I hope to see if I can find this robe somewhere else and return their robe and never shop with them anymore. I just want others to know what kind of people they are dealing with at suit avenue."

    Yes, that was an old style that everybody else received, that was discontinued; your size was out of stock in the old style, and that is why we had to wait a little bit longer to send you your robe, because we were getting your size in the newer style. In fact, the one you received is the one that is pictured, everybody else received the older style that is not even pictured.

    If you do not like it, let us know, and we can send you a return label to send it back to us (free of charge), and we will issue you a full refund.

    If you would like to keep it, that is fine too. We can offer you free shipping on your next purchase.

    Unfortunately, that is the only two options we have, as we do not even have the capability of getting that older style; the company is completely sold out on those.

  • I understand what you people are saying now that things are the way it is now. It is the principle of what happened is what you are evading. At the time I purchased the robe, it was on line and availabe at that time. When I was told to send it back for a smaller size, I was not told either by email or telephone that you no longer had that style. What I was told was that I will receive the exact initial robe in a smaller size, but when I received the substitue robe, the folks I dealt with on the phone including the so-called manager was rude and didn't seem to care what my point was. By telling me that you people sent me what was available and not what I ordered is bad business practice. And to have the reaction I received from you people on the phone before it got to this point was uncalled for. My husband has decided to keep the robe since it is too late to do anything about it now. The function he needed it for is too close for us to go another way. I still believe that the way you people handled this proved to me that you really don't give a darn as you make out to be now. I don't plan on doing business with you anymore and I don't need your offer of free shipping on my next order because there isn't going to be a next order. Case closed.

  • I'm about to buy clergy shirts at suit avenue and I come up on this claim I wonder if they do good business with people , now I'm kind of questioning myself I like the shirts they have but I don't know if I can got ahead and order them , I wont like to go through hell over the phone if there's any inconvenient in my orders, so what can I do ?
