The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Ms. Lester has contacted us several times and in each instance we have provided detailed feedback related to her case. Given HIPPA laws I cannot go into specifics, however, what I can disclose is that Ms. Lester is looking for a refund she is not entitled to. This has been communicated to Ms Lester several times and to her representative by several staff members of St. Gregory's Retreat Center. Accordingly, we will not be providing a refund and feel that we have been more than responsive to Ms. Lester. Additionally, I see that this "claim" was filed weeks ago yet I just received the paperwork on 9/19/2012 and I see that there was a deadline to respond by 9/15/12 or this claim will be made public, which has now passed. This appears dubious and fringing on extortion. Please remove this claim from your web service and any others it may be posted on or you can discuss this matter with my attorney."

  • The missing piece of the puzzle is really a benefit to the Claimant. The care was paid for upfront, private dollars, then St.Gregory cannot release information about any treatment provided to the patient. Healthcare Insurance Portability and Accountability Act or HIPAA is touted as being in place to protect the consumer. What it truly does is allow your medical treatment records to follow you from insurance to insurance. Want a new job with benefits? well lets say you had a kidney transplant 3 years ago and take a regiment of medications. You are competing with some one who is not a health risk like you are. Sorry to inform you that they hired some one else for that position. Before HIPAA, they would never have known your medical history.
    Unbelievable? I spent 6years of my life trying to prevent HIPAA and other reform from occurring. Like Obamacare, what started out as something useful and considerate, ended up an enormous mess that will devastate the very people who need it.
    To the claimant, keep insurance out of the picture. Hopefully, the patient's records of their time there will stay at St Gregory. The other comment from the public, while casting doubt and census taking, does have a truth in the mix. Never pay full price. If you are paying cash out of pocket, you should expect to 30 to 60% less than listed price.
    Embrace the good works the people St Gregory do every day.

  • I think St gregory tries to fill the beds with bodies and the negotiate everything. A. never pay full price!! B. Never pay in full up front for anything!!! You may want to leave then you are screwed. They will not pass up a chance to MAKE MONEY bELEIVE ME!
