Statement of Claim
Claimant says:
"I exchanged a property in Florida for a Branson Time Share; Spinnaker Palace Heights in July of 2012+ $10,000 more for the exchange. When I tried to reserve a slot for vacation in July 2013, they informed me I could only use my condo every three years.I am 68 years old and never would have wanted such a package. This was never clearly explained to me. The sales representative, Jami, told me I could use it 52 weeks a year, or as many times as I wanted to rent it. So, my daughter-in-law and I went to the main office in Branson April 26, and spoke to John, a manager who said he only deals with owners. We sat there from 11:00 am until 5:00 pm trying to resolve this issue. I was told that to get the package I thought I had was to pay an addition $10,000 dollars. I signed it thinking that was the only way I could benefit from this time-share. I feel like I was scanned, manipulated, and conned. In the package, it stated that I could cancel the contract (most current) as long as I did it within 5 days of signing. I called John the following day; April 27, 2013, and informed him I wanted to return to the original deal, as I didn't want to invest any more money. He confirmed that all I had to do was return all contract information and a written letter stating why. I did so first thing Monday morning, April 29, registered mail with notification of received package. I received the return receipt showing they had got it on May 3. Signed by Angela Fulkert. Then, two months later I receive a bill from Visa Master card stating I owed $5000 concerning this contract. I called the credit card company's dispute department and explained the situation and they said they would check into it. Today, June 24, I received a letter stating that Spinnaker had decided not to reverse the charge back since I had not cancelled the credit card. It was my understanding that when I returned the contract information with my letter for cancellation that was all I had to do. I never received any feedback from Spinnaker Headquarters (35 DeAllyon Ave., Hilton Head, SC 29938) regarding my cancellation, so I assumed everything was fine. What do I do now? Do I need to get a lawyer and sue them? Please help me resolve this mess. -Patricia Neff"
