Statement of Claim
"You, SHAPES/NATIONAL FITNESS have been taking money out of my checking account for ten months past the "Supposed" end date of my membership. I actually thought that it was only a month past the actual date. I was shocked to find out TODAY (from National Fitness) that my membership actually was up for renewal in January!!! Are you going to refund my money? I paid my fees for my membership and when it expired 30 days past someone could have notified me (Shapes OR National Fitness) yet noone mailed me anything, called me or e-mailed to say "Hey, we're robbing you Ma'am... you may want to send us something in writing to cancel before we deduct the sum total of your membership all over again without you knowing!""

  • I disagree with the explanation / grounds provided

    "It clearly states on the frot of the contract, that you signed, that you have read and understood the terms of the agreement. Under the Term of Membership and Monthly Renewal(also on the front of the contract) it makes the statement of how to cancel if you do not want the membership agreement to go into automatic renewal and how much you will pay monthly or if you wanted to pay in full for the year to renew the agreement. Once you sent in the cancel notice your account was canceled."

  • Why would you expect to reach a manager on SUNDAY or after 6m during the week?It seems like you were intentionally picking times when she wouldn't be there. Managers work business hours normally.

  • This seems like an unfortunate incident of the prevalence of lengthy contracts that people feel they don't have time to read or perhaps feel pressured to sign without reading them thoroughly. Although Shapes could have been more proactive in outlining some of the important terms of the contract when you enrolled, ultimately it is up to the consumer to be aware of the terms of any contract that is signed. Remember that by including these types of terms in contracts, it is advantageous to the company because some people do not take the time to read contracts or cancel a few months after the renewal without even using the service. This is "free" money to the company and companies in general count on consumers not wanting to take the time to read the terms. It is always a buyer beware situation and as a consumer, we need to understand what we are taking on as corporations employ many lawyers to write those terms.
