Statement of Claim
Claimant says:
"I was in a car accident on 3-13-13 and there was damage to the front end of my car. All of the radiator fluid drained from my vehicle and my car sat on the side of the road running in the freezing cold while I waited for Secura's road side assistance tow truck driver to come get me.

My car was towed to Mike Dorian Ford in Roseville, MI for the repairs. The dealership spoke with Secura Insurance and stated that I had a transmission problem and they, or the dealership never called to inform me. The dealership claims that Secura refused them to make any transmission repairs and was told to put new fluid in my vehicle and if it ran to return it to me...which is exactly what they did.

In doing so I feel that it was complete disregard and reckless endangerment of my safety and everyone else on the road. Had I been informed of this I would have refused to pay my $500.00 deductible or take my car from the dealership until it was fixed. My vehicle broke down and left me stranded and I almost missed the birth of niece's baby. My car was towed back to the dealership. They told me the damage was related to the accident and Secura wouldn't authorize the work. When the adjustor went to the dealership they told them a completely different story.

I had to pay out of my pocket for a rental car and the adjustor’s time at the dealership. I found another repair shop where I had to have my car towed once again and pay to have my transmission dismantled for Secura's adjustor to come look at it again. The adjustor was rude to my mechanic and basically stated that he already knew that the damage was not from the accident because of the statement the dealership made. I was told by Secura’s supervisor that they did not authorize the dealership to do any work on my vehicle and that only I can do that...funny that never happened.

In researching and educating myself by speaking with a nationally certified mechanic, owner of a transmission shop, and my current mechanic that this is laughable and that I've been “had”. Secura states that there is no physical damage to my transmission which is blatant lie. My vehicle's radiator and transmission share a tank and cooling lines and the cooling lines and radiator mesh grill and other things were repaired but this not physical damage somehow from their experience???

My car has been maintained to the most excellent of standards and I have never had a transmission issue, or, a radiator issue, or engine issue for that matter. My car never drove right after I got it back from the dealership. I have been informed by Secura that my car which ran for over an hour on the side of road with no fluids in it would not have caused the damage to the transmission because it was only idling and not being driven.

But the dealership however put fluid in it and supposedly drove it while performing their diagnostic tests as Secura claims it was never run?????????? Another false statement on their behalf. They also told my mechanic that if I had not had an alternator issue that I would not have had my vehicle back for repair???? What are the chances that my alternator and transmission both go shortly after an accident and none of this is related, just a bizarre situation, as I’m stranded in a mall parking lot in not the most desirable part of town and within a few miles on getting on a major highway.

Through research I feel that the dealership caused damage to my transmission and that is why they are attempting to cover their tracks and change their story giving alternate versions of what really happened. Since the radiator and transmission tank and cooling lines are shared, when they put new fluid in my transmission they SHOULD HAVE KNOWN the potential disaster that posed if any debris or radiator fluid was to get into my transmission. Especially since the lines were replaced. It acts like glue and destroys the parts in the transmission and the damage could appear in a day or a few months.

I have a report stating my transmission fluid was black and burnt??? Certainly was not the case before the dealership got their hands on my vehicle. The customer service and treatment I received from Secura and the dealership is deplorable to say the least. I have had my home, special riders, and auto coverage through Secura for many years. Obviously I'm in the process of insurance shopping. It is my mission to let everyone person I work with, liver near, friends, family members, or even someone I briefly encounter know how completely wronged, violated, and mistreated I feel. I have logged a complaint with Ford's National Customer Service and have spoke with my attorney in regards to disputing this claim. For paying my insurance premium on each time each month for years and purchasing my first new vehicle from Dorian Ford this is my reward.

I was also given a story that Ford has a known transmission problem with my make/model. Seriously...I purchased the car new at the end of 05 and have never had any problems whatsoever so that makes perfect sense!!!! I feel that I was discriminated against and taken advantage of based on my gender and they assumed that I would not know better or would be able to defend myself due to lack of knowledge. That is my definition of abuse of power and position. I have also written to the Consumer Protection and Fraud Agency based on this experience. Basically, I'm driving a rental car paying which I’m paying out of pocket for;had to pay for my car to be towed from the dealership after paying for their time with an adjustor I feel is obviously not qualified to make inaccurate judgments/decisions; my mechanic had to wait for over 1 1/2 hours at the dealership before they would release my vehicle even though I had paid them and authorized the release; pay for the transmission to be dismantled; wait for the adjustor to go out and look again which was pointless because he had a bias and predetermined mindset and was not interested in doing anything other than taking a photo; had too many unpleasant phone conversations to recount; claim was denied again; and now I have to replace my transmission and spend my time looking for any outlet to find some assistance or relief. I will also be billed for a 1/2 hour of legal time at $300 an hour.

Thank you for the nightmare and worst experience ever Secura and Mike Dorian Ford, I could not be more unhappy, mistrusting, dissatisfied, or disgusted."

Message from Secura Insurance Co: Ms. Rizzo, a SECURA insured, was involved in a car accident on 3/13/2013 damaging her vehicle. She submitted a claim to SECURA for the damage sustained to her vehicle. SECURA denied coverage for repairs to Complainant's transmission based on an independent apppraiser's inspection that found the transmission damage was unrelated to the loss/accident. SECURA offered $500 to resolve the matter with respect to the transmission and on 5/28/2013 Mr. Rizzo called SECURA and accepted SECURA's offer. This matter should now be resolved.
