Statement of Claim
Claimant says:
"I live in a no fault state, my PIP is 10k, I have met my PIP. According to Ky law one can sue with medical bills greater than 1k, permanent injury, death etc. The other driver admitted fault, he had let his insurance lapse. Secura wants me to settle for 2K stating they do not recognize any of the treatments (epidural steroid, facet injections etc.) dr. Visits since August 2013 yet in their release this contradicts any other treatment. I have been off work for greater than an year per dr order, working only aggravated the injury, I tried hence the pain. The insurance company has every dr. Note, which in fact they pick and choose what they will or will not recognize but consider my injury to be healed in less than 3 months."

Additional Communication Between Claimant and Secura Insurance Co Hide
  • Jul 04, 2015, Secura Insurance Co (responding party) added:
  • Another vehicle made a lane change striking Ms. Aters vehicle. The other vehicle did not have insurance in place at the time of the loss. Ms Aters submitted an uninsured motoirist claim to SECURA. On or abut 3/12/2015 SECURA offered Ms. Aters $2,000 to settle her uninsured motorist claim. On 5/20/15 SECURA corresponded with Ms. Aters repeating its offer of $2,000. On 6/03/2015 SECURA received an email from Ms. Aters advising she will settle for the $2,000 plus payment of a bill from KY Pain Care for a date of service of 4/11/2014 in the amount of $2,451.00. SECURA replied to Ms. Aters advising SECURA did not believe this treatment and bill was related to the accident and would not agree to pay it. SECURA's offer of $2,000 remains open if Ms. Aters is willing to accept it

  • Jul 13, 2015, Claiming party added:
  • Secura claimed they did not pay up to physical therapy in August of 2013. Yet they reimbursed all my bills and disputed a few. I have had multiple injections, which were not fun and deal with chronic back pain, thoracic which is well documented They received all medical records and some that were not needed,
Hence the discrimination. I am still not working and will not be returning to my career due to back spasms. Do no harm. I just want a fair resolution, not a settlement to satisfy Secura. In 1989, I was a victim of an auto accident, and 12 years later had a major surgery, thoracic outlet syndrome so I know these accidents can cause major problems down the road, I just want to be protected
