Statement of Claim
Claimant says:
"the rechage mower acelerates on a down hill and the speed cannot be controlled, It is unsafe, on level land the speed can be controlled, A cart came with it but the mower gets stuck on softer terrain. I have talked to sears and the shifted the problem to Recharge. I got no satisfaction from ReCharge, they said they could not help Purchased from sears on 23 Sep 2010, and did not use it that year since, lawn did not need cutting until the spring of 2011. called recharge at 866 393-3968 case #3858838. Sent letter to CT consumer protection 20 Nov 2011, Got a response from Consumer protectin on 30 Dec 2011, they suggested small claims Court, which was going to be my next step. I would like Sears or Recharge to take the mower back and reimburse me my Cost of $2653.06. nothing more, nothing less.

  • We have had contact with the claimant with a goal of resolving this issue. The claimant is clearly seeking to force a refund which will not be forthcoming. We take great pride in resolving any warranty issue in a timely manner and have offered same to the claimant. Again, the claimant has not been willing to discuss this matter.

  • This mower is unsafe for my terrain. It is not a warrenty issue. Plus If I did want the btakes, they (maker of this product want me to pay transportation to their site, that is unacceptabble. You need to make it right and take back the mower with all attachments and reimburse me. right now you are jerking me arrount. Please keep this public, this is not worthy of Sears to deny me a settlement.

  • I disagree with the explanation / grounds provided

    "We have offered to have this situation resolved using our warranty provider. The claimant has advised that they have purchased another gas powered mower and no longer want the item purchased. Under the warranty, we cover manufacturer's defects for a period of 2 years from original date of purchase for the original owner. Brakes as indicated by the claimant are not warrantied and would be considered a service part. We have further advised the claimant to contact our warranty provider should they like to arrange for 3rd party service."

  • Controlling the speed isn't the same as brakes. This sounds unsafe to me. Have you reported it to the consumer safety commission?
