Claimant says:
"In short they did not develope a swale when they shoud havbe between the houses.
My lanai developed 2" of water therefore the room developed mold. I am x Navy x Insurance 73yrs & so is my asthmatic wife. I gave the city of Palm Coast & Sea Gate several months notice this wll happen. We are on fixed income and will be short on putting our lanai back together again so my wife & I can use it again. This claim is $ 4,350 est. far lower than any room they would complete.

Message from Seagate Homes Llc: Mr. Van Orman,

I apologize for the inconvenience you have been caused by the dirt that washed into your lanai. The silt fence that was installed along our property line was removed the day before the final grade which would have created the swale that was to be installed. Unfortunately, the area received a heavy downpour shortly after the silt fence was removed which resulted in the dirt on your lanai.

It is my understanding that we promptly cleaned the lanai (per your schedule) and offered to reimburse you for the damaged rugs.

Although we take responsibility for the dirt on your lanai, we did nothing to create the flow of water to your property as the existing grade was well above yours well before we started construction. In our opinion this is not the first time water has entered your lanai from a weather event and we are not responsible for any water damage that has occurred.

We are willing to offer $500 for replacement of the rugs and inconvenience to you.
