Statement of Claim
Claimant says:
"Under Dr. Chandra at Scripps Green, I underwent incomplete treatments from two invasive procedures and had radiation overexposure from several CT scans within a short three months. Information from these CT scans were withheld from me by the doctor, who never told me that I had stenosis. I have paid $1,564.45 of out of pocket medical expenses to Scripps Green vascular surgeon, Dr. Ankur Chandra, to treat my pelvic congestion syndrome. At the initial office appointment, Dr. Chandra told me CT scan results showed stenosis of the left renal vein and that it could be the cause of my physical symptoms of pain and pressure when sitting, lying and during sexual intercourse. I was told by Dr. Chandra that there was no indication of the left renal vein narrowing after the first invasive venogram, and followed with a second invasive venogram one month later. Since my symptoms didn't improve, he ordered an additional two CT scans within 3 months. When Dr. Chandra told me that I needed a third venogram, I decided to change doctors.

What upset me the most is that this 2nd doctor told me Chandra's treatment was incomplete, and upon my request to see the reports, results from the two CT scans showed that I did have narrowing of the left renal veins, showing Dr. Chandra hid this important medical condition from me.

This ordeal with Dr. Chandra billed my insurance around $85,000, and my out of pocket expenses were $1,564.45. I contacted Scripps patient relations for a refund of my out of pocket expenses. An adjustment was made regarding hospital part expenses but Scripps has refused to reimburse my remaining clinical expenses. Tony Cardona, manager of Scripps Green's Risk/Medical Legal Affairs, was the last person I spoke to; he believed that Dr. Chandra had done no harm and that hiding true medical conditions from the patient was considered a "standard of care." He told me that I would have to sign a paper stating that I would not sue Scripps if I wanted a partial amount of my remaining $609.24 in expenses paid back to me. Cardona said, if I signed this paper ensuring I wouldn't file a lawsuit against Scripps, he would write a check, "for the sake of patient relations," in the approx. amount of $400.

Consequently, I went through two more venograms at Scripps without significant relief, before a final procedure at Stanford relieved my physical conditions. I am asking for my remaining $609.24 of out of pocket expenses reimbursed to me without the need to sign any papers."
