Statement of Claim
Claimant says:
"I feel I'm being harassed, targeted, and singled out because I filed a complaint a while ago regarding the neglected landscaping of the community. The owners must pay a monthly fee but the association was not properly maintaining the community and this is the initial reason why I complained.
After the complaint I noticed the HOA was coming after me for petty things that ended up costing me thousands of dollars.
They mandated me to paint the entire house when it didn't need to be painted, they also told me that I couldn't use the same color which is why it cost so much. An employee of the HOA was taking photos of the home and wouldn't identify herself, instead she started laughing. A week later I received a notice, the HOA demanded I add shutters to the windows of my home.
My tenant living in the location also noticed that I am being targeted and harassed. This has caused tension and a difficult situation between us and the tenant ended up giving me a 30 day notice. He felt as if he was being blamed for the HOA's "Violations".
I also have to take time out of my busy schedule to attend an HOA hearing regarding this incident to defend myself.
I feel like I have no choice but to sell the property because the harrassement has gotten so out of hand. I'm almost to the point that I will hire an attorney to personally sue not just the HOA, but the employees that are involved in this harrassement.
I ask to be left alone from this moment on. Meaning any demands made of me must be stopped immediately."

  • Your request for a hearing was granted by the Board of Directors and the hearing is scheduled for February 8th at 6pm and will be held at the Trails Community Center. I feel that the best way to resolve this issue is in person with the Board at that time which was at your request

    Please note that the shutters HOA claimed were removed were never there in the first place. If shutters were removed they were done so by a previous homeowner. As a part of your regular inspections of this property we are surprised you did not make the previous owner WHO REMOVED THE SHUTTERS comply by the rules.

    Seeing as I bought the house without these shutters and had no idea of their existence until I began to take notice of the poor maintenance not being conducted of the landscaping in our community and seeing that actual harassment is taking place due to my complaints to this fact, I will immediately take legal action if harassment continues. Further as a result of your bullying tactics and invasion of privacy practices, specifically the paparazzi like investigators with cameras taking pictures of the property and their inhabitants thereof, I have lost significant income due to the intimidation of my Tennant and there departure as a result.

    Please take notice that as a result of being singled out in the community the constant harassment of your team and your unreasonable demands and intimidation I am considering selling the property. Please be aware that this action will NOT be a choice but a forced upon decision.

    I am demanding that you cease all unfair practices against me and or my tenants now and in the future. Also the landscaping of the community is horrendous and makes our neighborhood look terrible and undesirable. We all pay a homeowners association fee monthly to have a reasonable looking community. I would like to see that my complaint of non maintenance gets resolved in a timely manner.
    asking also for $ 1800 reimbursement for unnecessary painting.

  • Again, you are not being singled out as there are a number of properties that have violations for having shutters removed without approval from the Association. While they might not have been in place at the time you purchased the property, violations go with the property not with homeowner. My recommendation is to meet with the board as per your request regarding this particular violation.
