Statement of Claim
Claimant says:
"On July 24,2015 I had a pedicure at Royal Nails, 16919 Audrey Street, Omaha, Nebraska 68136. Phone 402-934-6288. I asked for a quick 30 minute pedicure due to commitments for the rest of the day. The gentleman doing my second pedicure at Royal Nails was not pleased that I was not having the "Deluxe" pedicure. His English was poor but I did understand why not "Deluxe"? He made no further comments. He worked seemed angry. I made no more conversation. When I left the Professional Nail Business my Right heel was sore from filing. Within a short time my right heel had an open sore. I cleansed it well and put on A&D ointment. July 28, 2015 I saw my ER Physician he put me on antibiotics three times per day. I could not wear shoes immediately after the pedicure due to the pain in my right heel. I was instructed to watch closely because of the redness around the sore and drainage. July 28, 2015 I returned to Royal Nails showed them my right heel the open sore, the prescription I had received from my MD. I talked to Manager Lec and was given a business card for 2 free pedicures with him. Lec had done a wonderful job on my first pedicure at Royal Nails. I was told he would give me the 2 free pedicures himself! My heel was not healing. I still could not wear shoes. I am a nurse who is on my feet 40 hours a week in a busy ER. My scheduled first night after my pedicure was July 29, 2015 at 2000. I missed all my night shifts that week. (40 hours) On August 3, 2015 I visited another physician as my heel was not better and received more antibiotics. I was told at this visit I could not return to work until my right heel was healed and I could wear shoes. Again on August 3, 2015 after my Dr's appointment I revisited Royal Nails. I asked for the Manager Lec. He was working on a customer. An employee called Rose Ngryen at 402-507-8176 owner of Royal Nails. Rose told me to return to Royal Nails on Thursday August 6 between 1000-1900. I returned to the shop and met Rose. Rose was pleasant, she took a picture of my 13 day old sore. I provided her with my paycheck hourly rate, my work schedule showing her the hours lost at my work which was 104 hours. I also showed her my medications I received one empty bottle and one with antibiotics in it. Rose took a picture of my hourly rate and the schedule I provided her with my hours. Rose Ngryen told me her attorney would be in touch with me and write me a check. She said he would call me in 1-2 days. I have not heard a word from the attorney as of August 11, 2015. I was more than fair with Rose I only asked for my base pay. I work full time nights and receive a night shift and weekend differential. Initially I did not ask for this, I feel I should be compensated for my normal schedule. I feel this is really poor business ethics. I would not want any other customer to experience the pain and suffering, infection and missed work I experienced at Royal Nails."

  • 8-11-2015 at 8:39 AM I received a call from 402-910-5567, a gentleman from Royal Nails called my home, he first stated he was an employee of Royal Nails and than he stated he was an attorney. He told me I should have returned to Royal Nails July 24 and not have waited until July 28, 2015, after I saw my Doctor. I told him I was a nurse and I had been cleaning the sore with Normal saline and applying A&D ointment, taking over the counter motrin for pain. He preceded to argue about my treatment. Than he called me a FUCKIN BITCH and never return to Royal Nails.
